Article IX.        When the APVO started November 2007. The meeting

1.                  A frame up is easy to create when a leader’s power and authority over a person is used to implementan APVO with place and communication restrictions on total human existence. The only restriction that should have occurred was no texting for a short period but with every other means of communication opened up. I had apologised for any misinterpretation of what the text messages that were only a result of detainment from going to work. This is what happened while I was detained Rachel had told me she was recommending to the exec for me to go on a leave of absence and I was to go through her to come off it. After having gone to Western Sydney Alex had allegations, raised the gag order and why I was being restricted to central. I had requested that Alex myself and Rachel needed to meet for a mutually agreed solution. That Rachel needed to face and say it to my face and not behind my back and for us to work out a mutually agreed solution to it because while needs updating from Organisational Principles and Methods of the Democratic Socialist Party to the Organisational Principles and Methods of Socialist Alliance on page 66-67 “And there is a more general point of party concern – if a comrade’s personal actions affect the political tasks of the party, the party will discuss out the problem with the comrade concerned to try to resolve the problem politically with a mutually agreed solution.” Three comrades is not the whole party. It was two leaders using the guilt fix method on a new comrade who had just come out of the closet about the struggle for the rights of those born from adultery for communicating too much via text message to let us return to work with a little assistance to stop bastardisation violence acts. Alex organised it to take place at his house because he said there was no room at the Resistance Centre in Central. It should have taken place in the Resistance Centre so other comrade witnesses could have heard what was discussed and what was agreed to. Rachel just wanted to get it over and done with and it was literally like Alex had organised it in secret. We went to Alex’s house and sat down at the table. Alex was to my left Rachel was opposite. She told me, she didn’t ask if stalking her and I told her no. I just want you to let me return to work. I had apologised for any miscommunication and the texting.  She then asked me she could understand why I was texting her while I was detained but why was I after being released. I told her because she wouldn’t let me address the issue to help comrades like her understand. Rachel was incredibly angry with me. She didn’t realise using guilt fix method and the gag order that she was effectively and mistakenly detaining me. She had asked me asked me if I still wanted to be in the party. I told her it was very clear in my mind that I belong in the party. She had asked me if I loved her. I told her as my comrade, my mentor my mother, cousin, sister, teacher etc her living humanity the same as comrade but not for a personal sexual relationship or a sexual advance. Rachel had wanted provisional but Alex had said no provision existed for that unless I resigned and come back after six months. Alex accused us for joining for welfare. I told him. I didn’t ask Rachel to store my stuff at her house but she insisted until I got a house because I was homeless. I didn’t ask nor did I join for a sexual relationship with Rachel, I asked her to be my mentor besides my comrade. I didn’t ask for this to happen and I just need a little assistance to stop it. While the only restriction that should have been put in place was no texting other forms of communication should have been opened up. In page 39-40 of the organisational principles and methods of the DSP which needs to be updated to organisational principles and methods of Socialist Alliance. The party is “a supportive atmosphere”

-          “We need a comradely tone in the party and Resistance, in all our relations with other comrades. We aim to assist other comrades, and we shouldn’t let our own ego or our big mouth get in the way. We have to improve the level and tone of communication between comrades. We can’t afford any backbiting, sniping, cliquishness, or gossip. We have to move right away from general discussions that dump on individual comrades – unfortunately there’s been far too much of that in the revolutionary movement. The discussion has to be on how to go forward, how to solve political problems, how to help each other, how to build the party, how to help each other how to build the party. Trotsky wrote about the tone required by leaders: A patient, friendly, to a certain point pedagogical attitude on the part of the central committee and its members towards the rank and file, including the objectors and the discontented…

-          Methods of psychological “terrorism”, including a haughty or sarcastic manner of answering every criticism or doubt – It is namely this journalistic or “intellectualistic” manner which is insufferable to workers and condemns them to silence.

-          Of course, critics are not always right, so there will be vigorous debate, but a political atmosphere and the correct, that is, comradely, tone will ensure the right outcomes of the debates.

2.                  The agreements that had been reached in that meeting were that:

3.                  Rachel had calmed down to a certain extent and verbally agreed there was no truth to the allegations. The following was agreed to:-

4.                  That it had been an SOS call for help for Rachel to let Shelly return to work from leave of absence because Shelly had been informed by all comrades including Rachel herself that she was required to go through Rachel for this. That she accepted and had understood why I had texted while detained.

5.                  That it’s very clear in Shelly’s mind she belongs in the party.

6.                  That Shelly loved Rachel’s living humanity the same as any other comrade and not for a personal sexual relationship.

7.                  That Shelly did not join for welfare or mental health help. That she joined for revolutionary political, organisational, human help of each other to change the world.

8.                  That Rachel had wanted provisional of Shelly but Alex informed them that no policy existed for this in the DSP unless a resignation occurred from the DSP while one could continue to work in Socialist Alliance/Resistance in order for that to occur.

9.                  That Rachel was to take a two month break with a promise of return from leave of absence without punishment of Shelly which included full return of communication and place rights including the western Sydney Activist Centre.

10.              That Shelly would report to Alex Bainbridge until Rachel returned.

11.              That Shelly was assigned to work in central and CAAH while awaiting trial.

12.              That Shelly was permitted one phone call until communication rights were restored to let Rachel know when the fight for the house had been won as Rachel had insisted on storing Shelly’s property at Rachel’s house.

13.              I had also apologised for having to text but Rachel hadn’t given me much choice because she didn’t listen  to just let me return work that comrades and not just her needed to know this to help comrades in their training methods of new comrades. Don’t use the guilt fix method and never profess to be the true interpreter and political rehabilitation is better than personal condemnation as the person themselves is often the best person to tell people about their history. I just tell the truth. The only restriction that should have been put in place for six months that has been well and truly served as a punishment was no texting, not total communication and total place restrictions between my people and myself including Rachel. Texting was only a result of being detained and gagged in the first place with the SRC and the mental health system combined with the use of the guilt fix method between the leaders, our people and me. I couldn’t afford to have my own laptop with internet to communicate with when others used their power and authority over me to deem it  a sin to communicate in person in order to resolve a problem and my words weren’t being listened to so I was left with little choice except to go through third parties for the  task to not to believe but read. Che Guevara when he was alive most likely would have done the same thing when he didn’t get listened to before he was captured and killed.

14.              So even though it was literally like they were using psychological terrorism on me as my initiative even though what Rachel and Alex was doing to me hurt like hell more than anyone will begin to understand and I was crying all the time for their power and authority over me to stop being used like that on me and I was scared all the time I began to politically rehabilitate myself for the rights of others within the framework I had been permitted with the assistance of anyone who could help by doing what I do best help organise and fight for the positive solution with an amnesty perspective and not agonise or personally condemn simply because I was being condemned. Staying in Socialist Alliance and CAAH was the only way I was able to stay alive. I would have wound up dead if I didn’t stay if I accepted being denied who I am for a single second. If I didn’t rebel to unite with the majority for life. There’s no question about it in my mind and heart for the love of the living humanity of our people. If someone is crying their not mentally disturbed it is because others are carrying out something which is causing human suffering to themselves or others and it needs to be annulled and we just call it amnesty and start again.

15.              Yet unfortunately it was indeed an APVO using Rachel’s power and authority over a new comrade.

Section 1.01    Dec 07.

16.              Rachel took her anger out on me at the Chippendale activist centre in the stairwell week later. She would listen to stop. I wrote my first manifesto and about the guilt fix method. There was no texting to Rachel. I began to occupy to organise. It was only when the Occupy movement came along I was able to bring the History Will Absolve us and socialism and human campaign into the 21^st century and had a name for exactly what I was doing in response. The last time anything like this had happened was over fifty years ago in Cuba. It became very clear in my mind as well as to others the politics of the struggle had very strong links as to what was happening and that the solution to stop the guilt fix method is just annulment otherwise known as amnesty. If an order causes an endless battle of constant accusations and confessions, it doesn’t matter who started it that was right or wrong. Everyone get whatever they have got to say off their chest in a round table discussion. Just call it amnesty to annul it and we all just start again with a political rehabilitation strategy all persons involved can agree on. 

17.              Delegations for the national conference. I was picked as a backup delegate because I had defended Stewart Woolley. Rachel took her anger out on me for it. There was no texting to Rachel

18.              24 December2007. The house came up. The queers wanted to organise to go to Villawood to see Ali. Alex told me not to go. I called Rachel using my phone call. She was happy about the house and thanked me for asking about the Villawood Visit.  There was no texting to Rachel.

Section 1.02    Jan 08 National conference

19.              Rachel took her anger out on me. I didn’t text. Amber had said to tell Rachel to stop. The vast majority had no idea what had happened they were stuck dealing with the repressive minority. I came out of the closet about the struggle for the rights of the white stolen generation. Farida gave me the guilt fix method. I suggested a party trial needs to happen then. Farida told me she didn’t want to put me through that even though Farida, Rach and Alex already was.

20.              I was physically assaulted half way through the conference and received a concussion with temporary memory loss of about a year. It was just some random, I didn’t even get to see their face because they came from behind me. I wasn’t drunk as was claimed in my police record. If they had done a blood test that would have proven I wasn’t drunk just concussed. Rachel went and Occupied Bolivia and I went and Occupied Central and CAAH and Western Sydney was only agreed to after it was clear to western Sydney comrades I needed a break from Alex. The memory came back fully when I received a shock about the proposed APVOand after Rachel returned from Bolivia around the 15 February 2008. I was told wait until Rachel gets back and I also told this to Alex. It was literally like Rachel had created a mess with promises of oranges and sunshine upon return with no punishment after deciding to take a delightful holiday in Bolivia and I was the poor bastard that was left to clean up the mess.

21.              Alex put pressure on me to resign from the DSP. This party was going to do this in two years’ time and merge into the Socialist Alliance but wasn’t quite ready for it at the time. We were all attached to the DSP but Socialist Alliance was definitely our future because the public saw Socialist Alliance as our vanguard not the DSP. It was literally like a vanguard within a vanguard. I remember Tom Addy asking me what was the purpose in having two vanguards. we just used to say well Socialist Alliance is for everyone and if one wants to commit for lifeto the revolutionary struggle then people adopted the DSP. Tom Addy’s point made common sense a choice of our life needed to be made. The LPF choose the RSP because they couldn’t embrace the future Socialist Alliance as we did.History is all of us. A truth can be made a lie and a lie can be made a truth. It was considered not a lie about me if you believed what Rachel or others told about me. Charismatic leaders like Rachel are very convincing. If they said to point the finger at someone it happened and then the person didn’t get listened to prove otherwise. I had never come across it been mistaken before with comrades until it happened to me since November 2007. Alex had offered Green left sales committee. I had offered organising Mardi Gras as that’s what CAAH had asked as well as other work because I wanted to do more for the party than just sales committee to try and help us all overcome the enormous cruelty. I told him about the struggle for the rights of the white stolen generation.  He thought it was an identity struggle, he got it wrong. He refused to accept no means no to unwanted sexual relations with Rachel. He bastardised me. He took his anger out on me. He used Rachel’s power and authority over me to use the guilt fix method on me. He personally attacked me. He wouldn’t listen to stop. Farida couldn’t come to help with organising MardiGras. From advice from comrades I resigned in name only of the DSP and merged into the Socialist Alliance. I was the first comrade to do it two years ahead of the party’s time.

22.              Alan Priestly took his anger out on me about his leg and wouldn’t listen to stop. Alan Priestly also took his anger out on the Gay Sydney Nudists.

23.              I had asked for Farida’s help with CAAH but she was always too busy.

24.              I was crying all the time for both Alan Priestly and Alex to stop. Alex used Rachel’s power and authority over me and told people I was crazy so people wouldn’t believe me. He bastardised me. Brianna took her anger out on me.

25.              Western Sydney comrades told us to come to western Sydney under their authority so I did. I had painted the toilet red as an expression to show a red was being dumped on.

26.              Dick Nicoles assisted us with the insurance form for fair day and asked us to help Stewart paint the floor red. We queers  laughed from the paint fumes. Emilia had asked why was Alex using Rachel’s authority to take his anger out on me. The previous year in Dec 06/Jan 07 like a grandparent Dick Nicoles let me help sort the “Mérida” from the politics. I got very good at it. Dick Nicoles reminded me of Mr Miaki from the Karate Kid. Mr Miaki was my favourite character. I reckon Dick Nicoles got us to use old paint to remind me that laughter is sometimes the best medicine to get through painful situations.  I remember when I found out Mel was raped. I couldn’t stop laughing and said to Farida I shouldn’t be laughing because it’s not funny what happened to Mel. Farida said tragedy. There is a difference between laughing at tragedy and doing something about it as opposed to making fun of someone you’re putting through hell and not doing anything to stop it.

Section 1.03    Reclaim the right and whistles blown in the City of Sydney

27.              There was a group that was organising a rally reclaim the right to reclaim Oxford St because of the increased level of homophobic violence that was occurring at the time. A good idea that won a lot of people, but there was a group of sectarian fascists involved who were doing business deals of buying the movementbecause they wanted the lgbti movement to just be the gay men’s movement to the exclusion of the rest of the alphabet soup in the road to rainbow liberation. Anyone who threatened their interests that were involved in the organising collective or outside of the organising collective they shut down. We came across it in CAAH and it was agreed the whistle needed to be blown but by encouraging organised political mass action that would just expose itself. The rally they organised was proposed to be held at the police station in Harmony Park but with no march. We couldn’t convince them to move the starting point of the rally but we managed to convince the organisers to let the people march up Oxford Street to Taylor Square. We all knew as organisers in the movement that unless there is some political purpose in it like with stopping black deaths in custody or for the release of people or the cops are planning a rally themselves for their work rights you don’t occupy places outside the police station for any part of rallies or march up to police lines as it just looks like you’re going to fight the cops and the cops natural reaction is to arrest people cause they not understand why organised protest is so important to people. It was going well, CAAH had nominated me to speak. The whistles got blown. Yet at the rally they sent in a couple of hecklers. It was a good speech that even Alex said it was the best speech he had ever heard me give. Yet a few hecklers that even Mark Goudkamp said he could have throttled were permitted to get away with silencing the speech. The speech was that we needed unity to defeat any social caused violence and prejudice such as homophobia and racism that organised political campaigns such as the equal marriage campaign can provide. Farida listened to the corporate press instead of asking me about what happened in order to determine the best course of action. I needed assistance and had asked her for help early on not personal condemnation. I would have put Farida forward to speak with the speech so I was nominated by CAAH as the person to deliver it.It was an old speech Rachel had given in 2005 and I always acknowledge my sources. I just rewrote it in my own words and adapted it to the current material conditions while maintaining the political message of the speech.  I had writers block at the time as a result of the gag order.  The leaders within our people wanted to hear Rachel or some other leader speak at the time.  The leaders beginning with Rachel didn’t want to hear me speak so I gave them exactly what they wanted to try and eliminate the constant finding of fault and misunderstanding of me that resulted from Rachel’s APVO power and authority over me. Overcoming the enormous cruelty by fighting for and defending the political words and rights of others.

Section 1.04    February 2008.

28.              A man entered the Chippendale activist centre abused us cause he was drunk so he had to be escorted out. I had told him not to come because he was drunk. Graham had promised we wouldn’t be punished for it. He accepted I am a Revolutionary and had promised it would only be for a little while. I had insisted on seeing Graham. Luke had told me Alex and Graham had had a secret meeting. The AVO was proposed to implement. Alex couldn’t wait until the majority and Rachel had gotten back from holidays. He did it using his DSP authority Rachel Evans power and authority over me. He violated queer autonomy. Gave a false report. Luke Weyland, Rupen S, John Coleman, Colin Campbell, even CAAH wished to defend me. Luke had even asked for me to be at my own trial, to hear our appeal.There was no hearing just the AVO. Alex had said Rachel would be pleased about this. I had told him no she wouldn’t.Here is Luke Weyland’s defence speech to stop the proposed APVO.

32.              Firstly I’d like to say thank you so much for last night despite that little shit turning up to the SA west mtg. Based on the discussions after last night’s Socialist Alliance West meeting in relation to the unfortunate male who disrupted the meeting we had to remove & John's idea I have drafted together some motions to be tabled & voted for through the DSP, Socialist Alliance and Resistance if that's correct &I’m not overstepping my bounds. Please edit add or amend if incorrect. The context needs to be a little more political somehow if comrades want to use it too. Please forward.

33.              MOTIONS(If they can be simplified that could be useful)

34.              That mutual respect shall be maintained at all Socialist Alliance, DSP & Resistance branch meetings.

35.              That any comrade has the right to procedure the 3 strike rule & you're out rule to remove any member who is disruptive of the collective mtg who is considered to have broken mutual respect.

36.              (The 3 strike &urn out rule)That anyone who causes disruption to any branch meeting shall be asked to stop three times and if the behaviour continues to disrupt the meeting they shall be cautioned to leave. If it continues then the person should leave as motioned by the floor(This is called the 3 strike &urn out rule for a duration set by the majority. It worked well when I was an actor on film sets & in young Labor etc., when we had to deal with little shits)

37.              That any Socialist Alliance comrade has the right to procedure a motion during a meeting to remove someone who continues to be disruptive after the 3 strike rule has been initiated and refuses to leave after requested to do so.

38.              That after a majority rule motion to remove someone is made they shall leave immediately for no return period of time as determined by the collective.

39.              That reasonable escourtment is permissible to remove the person be used if the person doesn't leave.

40.              That any police follow up which results from the removal of such person be coordinated by a designated DSP comrade.

41.              CONTEXT

Section 1.05    The setup 5 February 2008

42.              Luke and I we're selling Green left in Parramatta mall. It had been agreed that Alex was to step down from being my organiser and that western Sydney activist centre would have power and authority over me because I had reached a stage of answering to the majority of the people as opposed to just an individual boss. It was a discussion I wanted to have with Rachel upon her return to also relinquish her power and authority over me where I’m just answerable to the party as a whole instead of having to go via an individual boss and then the party or the collective, yet at the same time I still needed an organiser with me because I wanted supervision and guidance but not someone who would just abuse their power and authority over me.  Where we could just guide each other. It worked well during NDA as I had read at the time of having at least one experienced comrade with me, any comrade from our people who had empathy and understanding of where each other was coming from and not just Rachel. Alex was a good revolutionary but it was like talking to a brick wall where I had to keep explaining myself in order to be understood whether it was because he lacked experience in what it was like to experience prejudice and poverty and enormous struggle and sacrifice or not being listened to I don’t know. I just know I needed and organiser to help us get through this to help us focus on organising instead of agonising about me. I never questioned everything that other leaders said and did and I couldn’t understand why he continually questioned asking the same question over and over again on everything I did and said when I had already explained it to him. It was literally like he couldn’t accept there was no truth to the accusations Rachel had made of me. I didn’t go to Rachel’s house to pick up my stuff until she got back and told me herself to come and pick my stuff up just to prove that this wasn’t about Rachel. That this was about a few leaders abusing their power and authority over me after working my guts out for the people and then just taking everything from us because they professed to be the true interpreter of the situation and of who I am while constantly digging because they find it hard to accept one can be so genuine with no hidden agenda because they didn’t bother to get to know me in the first place or because they want to figure me out because they not understand the struggle I come from.  Not everyone fits the textbook.

43.              Anyway an unknown male approached me. The unknown male wanted to know why we protested at APEC, why we support aboriginal rights and what makes someone who is born queer and wanted me to go with him for coffee. He bought a GL & took a leaflet of the film and asked if I was going. He appeared to be disorderly and didn't agree at first it was a peaceful protest. To which I replied you're being rude no thanks, wrong sex, and too many coffees make me bounce and unless he was interested in politics to go away and come back when he was sober and a human. He then apologised and then told me his story. He then asked if he could come to see the APEC film to learn more and I told him to go and get sober before coming to our events.  I then went over to Luke to do a paste ups and then I came back to help pack up. he then came back to the stall and took a leaflet.

44.              The mtg showed the inspiring APEC film and about an hour into it he came in talked loud, but got the message at first to be quiet. after the film he quite clearly didn't agree with our politics. it was a great film & look forward to hearing john gs speech on the anti-privatisation campaign. He then continued to interrupt and wouldn't stop, despite all our requests for him to leave if he was going to carry on like that and John was unable to speak because of him. John should've been allowed to speak but wasn't. So then John & Colin had to escort him out after it had caused disruption to the mtg. Graham and Colin then did a great job with politics & it was gr8 to hear about all the campaigns in general business and comrades asked me to focus on Mardi Gras cause I was struggling to hold back the tears over what had just happened as I felt responsible for the man ignoring my advice to go and get himself sober before coming to our events as a result of Rachel and Alex using the guilt fix method on me.Graham told me it wasn’t my fault and that I wouldn’t be punished for it. It was a relief just to get guidance from an experienced comrade in dealing with a difficult situation. While we were having a debrief the unknown male then came back later after the mtg was well over with cops accusing us of attacking him and inviting him which was incorrect as I had told him to go away and get sober before coming to our events.  To which the police response was "he obviously doesn't agree with urn politics" and we said obviously. We then finished and it was agreed we would have to address the issue of safety by the next meeting. We all left and the above motions came from those discussions after the mtg.

52.              On a final note even for just a little in that mtg while I was home cause I was accepted by the people without rejection & the world suddenly went the right way up &I hope to hear John G's speech on anti-privatisation next time. While yes I have a house a home is not something built by bricks or mortar or location or even family but something that is filled with a collective of likeminded fighters without rejection or blame that this cadre was denied till we met cadres in 06. Our instincts were just not strong enough to follow through to prevent him from coming on our own. (Comrades had suggested in central to work on our own but when it comes to people like that we're not strong enough just yet outside of institutions. While it's no one’s fault I was scared that was going to happen cause we're getting there but not quite trusting of our own instincts just yet, just in case)

53.              So perhaps based on Graham's suggestion to not invite anyone. How about refer them to other experienced comrades when selling etc. whether my instincts initially say "danger will Robinson" or not if they spark interest till comrades trust us again, if that sounds like a good idea.(in regards to males but I do trust most male comrades cause we never know which males to trust. females & all the most exploited like queers, indigenous & refugees don't seem to be a problem. kind of ironic really, no offence)

54.              It wasn’t perfect and needed work. The next day Graham and Alex met in secret. Luke Weyland told me about the secret meeting. One thing that puzzles me how did Luke know about the meeting. Anyway more restrictions were to be proposed using Rachel Evans power and authority over me to be legalised by APVO. Graham had promised it was only going to be for a little while. Alex didn’t want to wait until Rachel or the majority got back from holidays. Alex did a Luke Fomiatti using Rachel’s power and authority over me to implement an APVO without trial. I rebelled because our people had not even been permitted to hear the appeal as a just cause such as Socialist Alliance and CAAH is worth fighting for. No decision about my membership had been made. Just place and communication restrictions with untrue accusations about mine and Rachel’s involvement in the party and CAAH together. Below is Luke’s defence speech in response to the proposed APVO.

61.              Friends, where do I start?  Do I talk about lessons I believe that we all could learn from events that occurred exactly one week ago in Parramatta, Do I talk about the years of service and dedication to the socialist cause Comrade Shelly has put in ? Do I talk about the activities Shelly is once again taking up?  Or do I go over the fabled "Straw": that both Graham and Alex seem to believe broke the revolutionary camel’s back.

62.              Let’s start with last Tuesday.  Last Tuesday, there was a Socialist Alliance film night and discussion.  Here is a flyer of it.  Would I be right is saying that there was no restriction placed on who we could hand these out to?  I gave them out both at the mall the week earlier and at a celebration for Kurdish Iranian Communist Party.  

63.              That afternoon, for an hour, we each sold two GLW.  We both found a contact to bring along to the see the film. While my guest was quiet, her guest certainly behaved otherwise.  What if I had talked to the latter guy instead of Shelly last Tuesday, would I be blamed for his actions?  If not, why are we blaming Shelly?

64.              Clearly discussions could and should take place over whether there is a need for guidelines and if so what.  Such matters could include:

1.          What kind of risks are there?

2.          What advice and training do comrades need to become aware of them?

3.          How can such risks be minimised?

4.          Is a certain degree of risk inevitable when we open events to the public?

65.              Shelly's past service

66.              Whilst most of us here, through necessity, are part time revolutionaries, people like Lisa, Alex, and Shelly are indeed very special.  While I usually spend say two nights a week at meetings, attend most rallies, put up a few posters, and sell once or twice a week.  Shelly fights the good fight from the time her head leaves her pillow, to the time it returns. For years before I purchased my first Green Left, Shelly has been campaigning In a myriad of ways.

67.              Shelly has served on University Campuses, ensuring that the Student Councils are not just a social club but fight for the rights of all students, women and gays.  She has been actively involved in the fight for refugee rights, and in the past regularly attended Villawood IDC.  Shelly has done countless paste ups, leafleting, green left and CAAH stalls.  She has written letters to local, student and green left weekly.  She has helped out during marches and rallies in Queensland, NSW, Victoria and Canberra.   She has research the proposed nuclear waste dump near Penrith, Shelly has organised and participated in numerous working bees.  She has been involved in Stop the War Coalition.    Throughout this time Shelly has been loyal to the Socialist Cause, as expressed through Resistance, the DSP, and Socialist Alliance. 

68.              Shelly is always prepared to ask questions so as to get proper guidance.  Possible, at times Alex or Rachel may have found this more than a trifle annoying.    But with or without this advice being given, Shelly is a go getter prepared to take a stand for human rights, peace, justice and the environment.  At times people will no doubt say from the sidelines it may have been better done    a certain other way.   But it is far better done with maybe some imperfections, then never been done at all.

69.              Resignation from the DSP

70.              Late last year, Shelly went through a difficult period, and for a short time needed hospital attention.  After this event, Alex advised her that it may be better to temporarily leave the DSP, while remaining involved in Socialist Alliance.  Shelly took this advice.  Now Alex is using this very decision tonight to deprive her of the right to defend herself.

71.              I had asked both Alex and Graham if I could invite Shelly is my personal guest tonight for this reason.  Neither of them saw this as possible.  (Funny I was a guest twice before I joined)

73.              Shelly is busy once again.  The past depression is past.  Organised cadre at Blacktown campus,  Shelly has already been on Green left stalls  (but Alex stopped that) - She attended Socialist Alliance, plus Stop the War, CAAH, Mardi Gras Organising meetings, obtained special permission last week to run a CAAH working bee, painting banners, making badges etc.  at Chippendale, last Sunday, only to see the permission half way through withdrawn by Alex – without any reason.

74.              Activist Centres just for the DSP ?

75.              When I joined Socialist Alliance, I felt not that the activist centre was mine, but rather I belonged to it.   Our office has been used by Resistance, Socialist Alliance, Free the Refugees, Peace Groups, Aboriginal Activists, and CAAH until Sunday…. And many more.  I cannot perceive of any time in the near future that the west branch of Socialist Alliance will be banned from having meetings here can you?

76.              As DSP we have the right to deny people membership of our perspective but what right have we to tell the alliance what to do?  As far as the alliance is concerned, Shelly maintains in good standing with full membership rights and obligations.  Such rights include the right to attend the meetings.  14 x 24 = 336 and  SA meetings run for 2 hours.  What harm would be if what I and Shelly both believe is unwarranted, exist for say 334 of these 336 hours – and say even in these 2 hours, she be forbidden to invite a contact? 

77.              Tell me what are her crimes?  What rules did Shelly break?  None?  Is Shelly just a resource we once used and now wish to dispose of?  Come-on guys !!!  Let’s open your hearts and see Shelly both as a friend and comrade totally dedicated to the causes of human rights, freedom, justice & international democratic socialism.

Section 1.08    About 15  February 2008 Rachel’s return from Bolivia.

78.              Rachel came back a week after what had just happened. CAAHor rather Allan Priestly had made the decision until things calmed down to continue organising Mardi Gras outside of the Resistance Centre with the hope we could resolve it when Rachel got back.CAAH had wanted to be there too and thought Alex was kicking CAAH out of socialism that were also denied from being there. She took her anger out on me. She saw Allan Priestly take his anger out on me. Fairway. Alan Priestly took his anger out on me. Conner told me I was always screwing things up when I was helping him with the table. I was trembling at the every injustice of it. They had asked Motohar why was I crying all the time. Rachel laughed at me. One minute she told me not to put the banner on then she told me to put the banner on. I didn’t text. Rachel joined Alex and continued to abuse their position of power and authority over me.

79.              Emilia had told me don’t go cause she knew in her heart of heart I was going to help change the world. Rachel called me and told me to call her.  I tried to tell her.

80.              I began to receive personal and prejudicial false attacks including the guilt fix method via email from Alex, Greg and Brianna.

Section 1.09    March 08. Mardi Gas 08

81.              We Occupied Mardi Gras. The days before we had painted a banner. I had told Rachel about UWS and she got angry at me for participating in political discussion the Lecturer had encouraged us  all to do. Rachel went to check on her Spanish timetable for class. I tried to tell her what had happened but she was too angry. Emilia spoke with Rachel and then Rachel called me and had asked me to bring the CAAH banner. I tried to tell Rachel over the phone what had happened but she was too angry to listen. Rachel forgot the paperwork when I had suggested bringing it. Mardi Gras weren’t going to let us in. Allan Priestly wouldn’t listen to me that the Gay Sydney nudists could get us in. Rachel came back with no paperwork. The Nudists got us in.

82.              I wanted to carry the Socialist Alliance banner, Rachel told me to carry the Ali banner. Mardi Gras tried to take it from us. Motohar said to let go but I refused calling for help. Rachel came and got the banner back. She used the guilt fix method and didn’t listen to me to what had happened. Afterwards she sorry she forgot the paperwork. I told her that’s not the problem the order is and I haven’t had a trial. She told me to come back in six weeks and we would assess what to do about the situation then. Rachel called me the next day to come and help fight to free a refugee at the Refugee review tribunal. Tuesday Rachel called me up and yelled at me to get my stuff she had insisted storing out of her house.  She gave me a gag order for telling her about the next refugee action. Rachel left a note. I left a note in response telling her what had happened and left my phone with the hope she would give it back when she pulled me in.

83.              Rachel Evans used her power and authority and created a new CAAH Sydney e list which would effectively erase CAAH’s entire history prior to the date while erasing any existence of myself. 

84.              We went to Grow. The have a 12 step program. They wanted to lobby for change instead of campaigning for change. I told them I had to go and fight for my comrades and CAAH as that’s my 12 step program. I started getting a lot of phone calls from patients thanking me for curing them. I said I just talked politics you just realised you could go and join a collective organise a political human rights campaign to stop your injustice rather than dwelling on it and having a double bind over it cause you were made to believe you couldn’t do nothing about it. Grow asked me to come back and work for them because clearly their missing something from their 12 step program.  I just said thanks but, I’m supposed to give up being a doctor and I don’t do welfare. I’ve got to go and fight for my people and stop an AVO. They sent me a reference.

86.              I Sonia Attard, Fieldworker  Coordinator of the Nepean Wentworth Area has known Shelly Anndahl for three months and in that time I have seen Shelly grow in understanding and knowledge as life as a whole. 90.              I Occupied UWS for studies and wound up doing some organising. Trish had agreed it was the correct strategy to organise campaigns to help stop the order. I didn’t go into the SRC because the party had made a decision not to enter the SRC so I just organised with students outside the SRC. Calls to the office to other leaders  for a hearing went ignored. I rebelled the order and using my key I occupied the Socialist Alliance branch in western Sydney activist centre and read political books crying looking for answers to resolve this situation for comrades and CAAH between Rachel, Alex and myself.  I distributed Green Left Weekly and would leave the money in the office. 99.              I have known Shelly Dahl since 2006.

100.          Our relationship has been both platonic and professional as we both set on the board of the University of Western Sydney Student Association for 2006.

101.          Personally I have the deepest respect for Shelly. She is loyal to are fault, very trusting of others (sometimes to her detriment), will always be the first one to stand up for a fallen comrade and was the first and only person to offer me support after I was the victim of a gay bashing on the UWS campus on January 14 2007. That bashing led me to become evicted from the student residence and suspended from Uni due to a counter claim made by one of my attackers as a defence for his actions.

102.          Shelly instigated immediate action against the University to correct this awful wrongdoing. I have never had a friend go out on a limb like that for me and will always be proud to know her.

103.          In 2007 I witnessed her sacrifice her personal and academic time for the causes of queer students at UWS only to experience the most horrendous back stabbing and vote stacking, instigated by a Mr Luke Formiati (now an ex UWS student). Luke used his own personal political agenda to create an illusion of distrust, confusion and lack of leadership ability in Shelly. This campaign of lies and vote stacking saw her removed as the UWS Queer officer by the very people she thought she trusted.

104.          This caused me to hold grave concerns for Shelly’s mental state of mind which I am positive was the cause of a psychological breakdown.

105.          Furthermore, the UWS Queer Collective has never recovered from this.

106.          During the period between 2006 and 2007 I witnessed the forming of a relationship between Shelly and Rachel Evans which was based on the strong belief of ideologies, equal rights for all queers and solidarity between all the petty squabbling sub factions to form a united front. I never witnessed any sexual tension between them and they both conducted themselves in a professional manner in public. Anything which is alleged to have happened behind closed doors should remain there, unless we’re in 1970’s QLD where the police would break down doors in anticipation of finding two men engaging in homosexual behaviour. But we’re not, so that topic is off limits to everyone.

107.          I witnessed Shelly suffer financial hardship and go for days without a meal because she was so entrenched in what she believed it. That I believe is the sign of a true activist. A person who puts themselves last for the causes they believe in.

108.          I have never witnessed any signs of fanaticism or extremist in Shelly, but rather a strong passion for equal civil rights for all.

109.          I’m sure some people may mis-construe this as being whatever their political agenda requires them to be, but I am one of those rare people who have absolutely no political agenda.

110.          All I see is Shelly trying to help and being stonewalled every step of the way.

111.          I have read the accusations made against Shelly and I think they are fanciful, baseless, desperate, and full of hidden agendas and fall very close to defamation of character.

112.          In conclusion, if these unsubstantiated actions against Shelly do not stop forthwith and she suffers another breakdown, (which I suffered at the hand of UWS and sued successfully), I will not hesitate to launch civil action against Alex Bainbridge and anybody else involved in this ambush.

113.          Shelly must be reinstated with all restrictions lifted immediately.

114.          Shelly is not the enemy, but rather, maybe all the people pointing the fingers at her need closer examination.

115.          In conclusion, I consider Shelly Dahl a true Socialist. This is based on my many interactions, correspondence and physical evidence of her devout Socialist Ideals.

133.          I have known Shelly Dahl for approximately six months after becoming friends when we were fellow students at the University of Western Sydney. Shelly was well liked by many students as well as tutors and lecturers. She seemed committed to her ideals and showed excellent leadership qualities. During lectures and tutorials Shelly did not hesitate to speak up and her diplomatic delivery was  appreciated by many.

134.          During group activities Shelly showed a deep understanding of others and demonstrated strong self-discipline when views differed. When asked to work as a group, it was known that, Shelly could be relied  upon to consistently produce quality work within the required timeframe.

135.          Shelly often spoke of her outside activities with different organizations. She was gifted in being able to bring together current issues of particular cause on which she was focused and relate it to the various modules we were undertaking. She sought to inform myself and others for the betterment our own understanding, widening our scope and dispelling unfounded bias.

136.          It has been my pleasure to have met Shelly this year. She is hard-working, focused and trustworthy and her contribution and presence will be greatly missed and eagerly await her return to fight for our rights. I am sure she would be a valuable asset for any organization.

144.          I met Shelly six months ago when at the University of Western Sydney.  During this time she has given me reason to believe that she is a sincere, committed and tenacious fighter for social justice.   For these reasons I am happy to support Shelly by providing this reference.

145.          Despite enduring much personal pain and hurt through oppression and antagonism from  individuals in a group she had come to love and respect, she has found the strength to fight for justice and  to return  to the work she loves:  Shelly has been courageous and honest enough to admit and address her own failings in the past and yet at the same time she has remained focused on the core problem, being one of miscommunication, ignorance and fear.

146.          Another commendable trait I have observed in Shelly is, rather than resorting to displacing her righteous anger and pain onto others, she has not given up the fight for the majority.  Too often, we listen to the voices of those in power rather than going beyond the façade to see that the truth is not only stranger than fiction but can be estranged from the pillars of society which we sometimes find are based on shaky foundations.

Section 1.13    April 08

152.          We Occupied Tibet rally. It had been 6 weeks and Rachel had told me to come back after 6 weeks. I had asked Farida previously over the phone that I was doing an assignment on Fidel Castro. My anarchist lecturer in March 08 at UWS had put up an article that suggested Castro supported Pinnoche and said she didn’t believe it to be true but said to 300 students that it must be true. I stood up and said, “Castro never supported Pinoche, he fought to free his people from the Batista dictatorship why would you want to convince 300 students to frame Castro with corporate media spin?” It was the same time I started wearing the clothes, cause what had happened to Castro was happening to me. Farida said “there she is” while she was talking to western Sydney comrades at the Tibet rally. That “Scholarly article” by the way was funded by the CIA who used a university to try to convince the public to frame Castro again. I went to Street Level and began helping the poor to mobilise.

Section 1.14    May 08.

153.          The LPF abandoned Socialist Alliance because they didn’t fight to unite with the majority. The LPF had refused to pull themselves out of the LPF and back into the majority and accept some political rehabilitation with no personal condemnation. 

154.          We occupied the IDAHO rally. We all went and had a get together afterwards. I had written reports about my activities and the difficulties with the order and the solution for the party and hadn’t had much success in getting them heard from the leaders. I had said its awesome news about Ali being freed from Villawood. Rachel said in anger to me why don’t you text him. I had said, Love to but you have my phone and won’t pull us in and give it back. Rachel was dumbfounded. CAAH had asked us to come back to work. The next day while Occupying the IDAHO Picnic Rachel was actually almost her comradely self. I asked how was our western Sydney activist base going and she said, “It sucks”. I said maybe it’s missing something important. So then I tested Rachel when she tested me on the countries that have legalised Equal Marriage with the hope she hasn’t forgotten her politics too and gave back to her about Canada what she had given me about the western Sydney Activist centre. No Rachel hadn’t forgotten her politics and gave very detailed info about Canada’s fight for Equal Marriage rights. Then why was she doing this to me if she had such a good memory and what is the solution. I was remembering our history looking for answers to stop the order. The order being the double bind guilt fix method moment. On the one hand these are my comrades that I love dearly yet there is an order using Rachel’s power and authority over me to incite hate and prejudice towards me with Rachel to Alex to Brianna to Farida to Conner always taking her anger out on me. The guilt fix method was like a plague that starts with two leaders’ power and authority over a person. It would capture this person and that person and then come after you and the prison would grow tighter around the person the guilt fix method is being used on.  You could tell who was captured by the order because they would act in a negative opposite of their normal behaviour and those who were a sleep to it. Then Rachel said to me, “Get up and shake these people’s hands what’ve just arrived.”  I said sorry Rachel and got up and shook their hands. I asked just as Emilia and Rachel were leaving if I could see them when they get back to resolve this. It had been agreed.

Section 1.15    CAAH mtgs

155.          I occupied CAAH mtgs. I kept coming but Rachel wouldn’t let me in the door. Rachel had said CAAH was not a Socialist movement. I said of course it isn’t, it’s the queer movement but it’s an important part of the struggle to winning a revolution so why are you carrying out the order here? Rachel had told me at another meeting when she was blocking the door that I do belong and I had asked her then why do you treat me like this instead of letting CAAH and comrades give us a go. She only let me into the meeting providing I was going to be dead by NDA. CAAH new nothing about what had happened nor about any order and didn’t know Rachel had been stopping me from going to work. So we put the motion up for the right to speak at CAAH meetings. one no vote Rachel. Two votes yes. Simon Margin and myself. The vote had won by abstention to annul the order to allow us to stay. It had been proven abstention is an amnesty decision. Rachel said, “Majority is majority.” After the rest of meeting that had gone incredibly well. Norrie stayed back to play mediator. Everyone else bolted. Rachel shut her eyes and said nothing. I had never seen Rachel lost for words as I had just proven the order was false which created a false history about me. That it was just a few leaders decision it was not the majority of people’s decision. I just shook my head because I knew Allan Priestly and Rachel had duped CAAH. Alex and Rachel had duped comrades. Those who followed carried it out believing it was a majority decision. They just raised their hands because a charismatic leader was able to use their power of suggestion to convince them to do so. I began to wonder how many more false orders had been created with others who are never heard from again and buried to death by these false orders. How many more people’s lives that had been framed by a charismatic leader’s power of suggestion using their power and authority over a new person when they made a mistake in misjudgement of a new person. That leaders like Alex and now Rachel saw as a threat because they knew about the guilt fix method leaders that was used on new people who were misunderstood. I wasn’t the one who made the mistake. It was Rachel and Alex. 

156.          While I continued to occupy for full Equal Socialist alliance, Resistance, Resistance books, Green Left Weekly and CAAH rights, I also occupied Street Level, Grow, and the Aboriginal Rights coalition (with full consent and support of aboriginal people) . In the city it was Alex. In western Sydney and CAAH it was Rachel. The majority of comrades and CAAH people wanted me to help, but Rachel would use Greg, Brianna, and Alex to stop us.

157.          Rachel’s APVO incited Alex and Greg’s emails which tortured me and personally attacked me for continuing to come to unite with the majority to help organise campaigns and distribute Green Left Weeklies. Alex, Greg and Brianna resorted to espionage and sabotage to shut us down  every time they saw my efforts were going well for the party to resolve the situation. Alex did it at the Aboriginal rights coalition and any other organising meeting I went to. Brianna we follow me when we occupied UTS and UWS and when I went to meet with her to talk about resolving the situation, she would take her anger out on me and slam the door in my face . I told Alex when he kept standing over me and watching me paint a banner. Getting enough dirt?  

Section 1.16    Winter Magic Festival

158.          We Occupied the Winter Magic Festival I decided to go to the Blue Mountains where the people would have great empathy and help resolve it. I asked Viv can Rachel use Brianna and Alex stop me from going to the Resistance Conference to resolve our situation. Viv said no and let me help distribute leaflets etc. Then I took another brave step forward and went to distribute Green Left Weekly. Rachel came into the stall, yelling at me and using the guilt fix method Greg put his full weight on top of Green Left weeklies. I said what can I do for the party to stop this? Rachel said to me, “You know what you’ve got to do.” I just said, “I’ve been doing everything in the entire history and existence of the human race while forced to say nothing to get the truth to comrades to stop this order. I’m not exactly getting any guidance, I don’t know what my crimes are supposed to be to deserve being held a prisoner and treated like this when I have asked and asked and asked for help and guidance through this on lodging an appeal because I’ve never stayed to stop this because I was only a little girl when it happened and had to keep my mouth shut, do as my told or I would get punished. Marion’s answer to deal with the bullies at school when the school wouldn’t do anything to help stop it when they found out I was I white stolen generation, a lesbian or a socialist or because I’m from poverty was to keep me home from school or move us to another Town and told me to keep my mouth shut. You keep running from bullies simply because a few leaders tell you to, you will be running for the rest of your life with no end in sight to the nightmare where eventually there is no place left to run. When I found comrades and CAAH there was no place left to run. I was reluctant to fight for a house because I never knew if I was going to have to run again. That’s why I initially gave the keys to Rachel as well as my pension card as well as my phone etc. because there had been no point in fighting for those things for the party and CAAH if I was expected to just die or run again.  A stable income, a house they don’t mean anything to me without my replacement family. Even the uni degree don’t mean nothing to me without my replacement family.

159.          They told me finally I could get my licence and state debt would just take the debts out of my pension. I only ever had a learners permit. I went through a driving school and I had low self-confidence. The driving instructor would yell at me instead of guiding me and I made mistakes. I found another driving instructor who had patience enough to give us a go and not yell at me if I make a mistake cause I’m only learning and he tested me. He told me I was one of most intelligent student drivers he had ever had the privilege of instructing because I learned very quickly who followed instructions well. He told me that naturally anyone with low self-confidence being yelled at instead of guiding them when just learning is going to make mistakes they normally wouldn’t make. He told me that not giving someone a go who wants to be given a go and just finding fault with them instead of guiding them through difficult spots people don’t learn how to get better.

Section 1.17    Resistance conference 08

160.          We Occupied for the Resistance Conference to try and get the truth heard on the platform. Stewart Woolley and Amber fought for Rachel to let us in and be given a go. I was told to keep a low profile though. I fought for Brianna to stop punishing me let us in and give us a go as comrades want us there and Rachel okayed it. That permission was granted. Mel agreed that Rachel needed to stop taking her anger out on me. Rupen, John Coleman along with others who knew about it had said it was too harsh to do to a new comrade with low self-confidence. I had compiled over 10,000 contacts for the NoToPope Rally and gave it to Emilia instructing her on the importance of contacting with ideas and suggestions of what needed to be done. Rachel stopped running and stopped being angry, just stopped and starred, confused with a dumbfounded look on her face. Farida lost her phone, Stewart Woolley found it and I came and gave it to Farida looking up to her yearning for her to remember me and tears were running down my cheek. She stopped and starred and just said thank you. Colin Campbell had said I was incredibly brave and had asked when are they going to drop this order and just let us in give Shelly a go that just needs a political rehabilitation order to rebuild self-confidence and not a condemnation order. I had asked the conference organisers Brianna and Alex and even Rachel for the exact purposes of the conference in order to address it and for the appeal to be heard there but they took their anger out on me. Alex told me I was crazy. Brianna slammed doors in my face. So I was told by other comrades to go see Rachel. Rachel took her anger out on me. I went and occupied the western Sydney activist centre looking for answers in the books crying to be given a go. A friend of mine sent and signed the ticket to QC over to Rachel’s doorstep because Mel and Farida said they weren’t going to go this year. It had taken me 5 months to save up that money because I was hoping at QC it will help Rachel and comrades remember history and realise the proposed AVO was a mistake.

Section 1.18    NoToPope.

161.          The implied right to political communication was won and fought for in the supreme Court by Rachel Evans and Amber Pike under a constitutional challenge. Rachel let us in but I had to spend most of my time fighting to be given a go. Alan Priestly verbally abused, yelled and screamed and took his anger out on me for coming to help organise NoToPope rally. Various Scarlet Alliance members who identified as queer white stolen generation and revolutionaries had reported similar experiences of prejudice towards them because their sex workers/orphans/queer white stolen generation and had been fighting for years for an inclusive united campaign. I advocated for them even though were all scared to just turn up and join the fight for the right to unite with the majority for any campaign to change the world. The poor they reported similar experiences as well.

162.          The first casualty of the order was Colin Campbell as a result of what he witnessed the orderdied. He didn’t have heart problems. He called me the night he died. He told me that order was false and to not give up fighting for comrades and CAAH to know the truth to stop the order and just call it amnesty so we can come home. He told me the contents of Alex emails to the list before the majority even decided

163.          Due to Allan Priestly and Rachel continuing to block us with the proposed AVO numbers for the NDA dropped from 3500 down to less than 1000. NoToPope was a good turnout of 1500 people. I was determined to revive NDA and not let the order kill it.

Section 1.19    Socialist Alliance State Conference

164.          I Occupied Socialist Alliance conference Newcastle for 18 hours. Rachel left early but I continued to occupy fighting for the truth to be heard. I intended on going to the socialist Alliance conference in Newcastle as I normally would under normal circumstance with no AVO order being proposed to be but in place. In this case it was just Alex because he doesn’t support the right to rebel place and communication restrictions to unite with the majority. Conferences are the place where appeals get heard from accused persons. The majority has the right to trial their own accused in their presence with complete non-interference of the state  the no one not even the leaders themselves have the right to stop. The majority all wondered why for around 18 hours I had to suffer from hypothermia. If it wasn’t for empathetic comrades who brought me hot coffee and some food on the Occupation fighting for a hearing and who got us provisions to go to the restroom so I wouldn’t have to go in the gutter because there was no toilets or look through bins for food because I only had $10 left after conference registration.

Section 1.20    9 August 2008 Meeting with Rachel, Rupen and myself.

165.          I had requested a meeting at the western Sydney activist centre. Yet no real discussion had taken place. Rachel told me that my constant texting was getting to be ridiculous. I told her I wouldn’t have to text if she just let me come to work for us to resolve it together. Then Rachel told me, “she don’t find me hot and she don’t find me sexy.” I told her again,“I told you before I never wanted a personal sexual relationship with you, I didn’t join for that. I want the party and CAAH and that an appeal needs to be heard. So Rachel told me only go through her to resolve it and don’t go over her head while at the same time told me not to speak. I had gone to other comrades and CAAH people about Rachel stonewalling me from coming to working to resolve but other comrades and CAAH people and they would always tell me to go see Rachel to sort it out. I couldn’t understand why Rachel was just throwing all the time and energy that had been spent into training me for the revolutionary struggle in the garbage.

Occupy the Courts 1  Rachel organised the original APVOnot the extension from police advice.

166.          On 29 August 2008 Rachel Evans position of power and authority over me was applied to legalise the APVO at the Newtown Local Court from police adviceand Alex’s advice acting without investigating the matter herself first.It was handwritten in her handwriting and stamped by the Newtown Local Court. Farida Iqbal always said you could trust Rachel’s politics but don’t trust her grammar.

167.          While its fair to say that perhaps she organised it because she realised I had been judged without trial while she and the majority was away on holidays by a misuse of her power and authority over me by APVO. Or perhaps because she’s like an overprotective parent the application was still a clear misuse of Rachel’s power and authority over me of a proposal to turn a civil trial into a criminal trial based on a misjudgement. Efforts to speak had continued to stonewall efforts for the majority of our people’s right to trial us. I understand it was an important part of the campaign at the time but you don’t put violence orders on people calling for help to fight for life stop bastardisation violence and prejudice from happening to them. The harm done out ways and mutual benefits such an order creates. It was clear mistaken proposal of sexual assault by APVO of myself. I had thought at the time after being held a prisoner for eight months at least we would finally get trialled to lay the allegations to rest to return from leave of absence without punishment. How sad I was to discover that in AVO cases the defendant gets judged without trial where the defendant has to spend their time and energy fighting for a trial and fighting to revoke it if they are innocent.

168.          I had been told by comrades to contact her to resolve it. She would tell me to only go through here to resolve while at the same time and given me a gag order. I wouldn’t have had to text her in the past if she had just let me come to work so our people could trial and test us for themselves in order to continue to fight for life to make that determination of which since November 2007 she has denied them the right to do due to a legal order which effectively made me an illegal humanagain that I actively fought to stop for 28 yearsand won the day both CAAH and the party and myself officially adopted each other. I had to wait 34years just to be allowed to speak with two of my biological brothers and two of my biological sisters out of four biological brothers and 5 biological sisters and we have no emotional human connection with each other as a result of Lester’s state order since I was two years old. I gave up looking for them when I found the party because I had comrades and CAAH and more brothers and sisters and a mum than I dared to dream of and that was enough for me. .

169.          Suicide and self-harm is the result of someone receiving social violent prejudicial acts and constant blame combined with the guilt fix method for those acts from others. It is not a death wish it is an sos call for help to fight for life to stop the social prejudicial violence acts combined with the guilt fix method received from others. People recover from it through social inclusion and encouragement to stand up to it politically and organisationally.

170.          People wind up death if you put condemnation and human isolation orders on them.  It is also a contradiction to put an AVO on a person for suicide and self-harm. The further harm done to the person using the persons own community out ways any benefitsthe person receives.

171.          This effectively proposed to make me an illegal human without trial before any order was legalised or put in place. It was homosexual assault of me by AVO because of the refusal to accept revolutionary advances are not personal unwanted sexual advances from me. between Police always act without investigating both sides of the story first in order to find an alternative solution such as referring these matters to community justice centres.

172.          A well-known slogan from Resistance is “When injustice becomes law Resistance becomes duty” Hence when the proposed AVO was about to become law to create a false history to bury an injustice happening to a victim, Resistance from accepting the AVO become my duty to fight for equal Socialist Alliance and CAAH rights for the party and CAAH with a Socialist Alliance strategy.

173.          Revolutionary law number one. When leaders make promises of oranges and sunshine including promises of return from leave of absence without punishment to the poor who work their guts out for leaders for giving them a go don’t misjudge them or deny them life or take and take and take from them and never give anything back in return or you’ll never hear the end of it.

174.          Someone continuing to come to work to continue to organise political campaigns to unite with the majority even though a leader tells you not to is not stalking/harassment/intimidation/ or a personal sexual advance especially when they do it based on their prejudicial belief that a victim recovering from trauma and torture is incapable and a mental health and welfare issue who should be given a chemical lobotomy and isolated from the entire human race. If you put orders in place to attempt to isolate from one’s peoples a human being who belongs with them but is recovering from trauma and torture they die because your re traumatising them and re torturing and forcing them to relive the experience 24/7  every time you give them any act of the order and the guilt fix method for refusing to accept and rebel the order to unite with their people. 

175.          What kind of political education was I supposed to get if everything I say and everything I do is deemed as a unwanted sexual advance, an obsession, stalking act or whatever other untrue inhumane accusation is used to justify the violence order on a victim? What kind of self-confidence was I supposed to get if Honourable leaders and Honourable judges majority activity is about doling out guilt? At the heart of such a method kills and destroys human life. Political rehabilitation orders and not condemnation orders is the way of the 21^st century because the physical and psychological harm done from personal condemnation orders of accused persons outweighs any mutual benefits for everyone involved.

176.          It wasn’t against me it was against uniting with the majority to continue to help organise political human rights campaigns to win an equal revolution life wants. It was against equal socialist alliance and CAAH rights for white stolen generation/orphans. It was against the alliance being the replacement of the family in special cases. It was against lgbti people working together to organise political campaigns to win equal love equal marriage and an equal word for everyone. It was against all the politics, organising and human solidarity of Socialist Alliance, Resistance, Green Left Weekly and Community Action Against Homophobia because when you go against me your going against yourself.

177.          Bastardisation as it is called in Australia, called hazing in America is any act within a group by leaders who use their power and authority and majority activity over a person which debases, humiliates, tortures, condemns, personally attacks, corrupts, manipulates, ridicules, mocks, denies who a person is, belittles, dehumanises, constant unreasonable demands with punishments of the person if they disobey, techniques of sleep deprivation in order to systematically convince the person to obey  a leader’s unreasonable orders at all costs even if the leaders orders is causing harm to the persons human life. The only way for the person to overcome it is civil disobedience of the leader’s unreasonable demands and orders on that person and no punishment or guilt fix method used on them. Just let them rebel. As long as they unite with the majority politically, organisation ally and humanly just let them rebel and don’t give them punishment for it. The right to rebel is well respected throughout the world except in AVO cases with place and communication restriction that holds one a prisoner of implacable constant tyranny that abounds by no code of law be it legal not has it been humane. 

178.          On 1 September 2008 two new South Wales police officers came to my house to deliver Rachel’s APVO power and authority over me.

179.          That night I dropped around spare copies of books of the party and the CAAH struggle to Blake and said, “You tell the leaders to call it amnesty for the party and CAAH and all the people out there if not for Rachel or for me at least for them. I’m not accepting a personal condemnation and gag order as the solution to this situation. We need political rehabilitation as I’m fighting for equal Socialist alliance and CAAH rights for life. We need a conference. This is what I’m fighting for.” I was told by police that I had to go through the court system to sort it out there and that I would get a hearing there. Unfortunately that didn’t happen. I was being misjudged and detained like a refugee without a civil trial.

Section 1.21    Occupation at the Western Sydney Activist Centre

180.          I held an occupation in the Western Sydney Activist centre in Response. The AVO was used to shut it down. When the police broke in they couldn’t have treated me with the greatest respect. I knew what they had come for. They explained their predicament to me. They told me we can’t charge you because the AVO is not legal yet but if you declare your ill the AVO won’t go ahead and we’ll publicly condemn Socialist Alliance. I could not allow Socialist Alliance or CAAH to be unhesitatingly be destroyed but I could also not accept that order either nor declare I was ill because I knew exactly what I was doing and I knew exactly what they were doing because I value people’s honour and human life which is worth much more. So I said to them, You know your duty I certainly know mine. I don’t sell out on Socialist Alliance or on my people.

181.          They signed it any way. I was detained for four days in a maximum security. I was physically andverballyhomophobic allyassaulted, red baited, bastardised and tortured and drugged with Lithium that resulted in damage to my nervous system because I’m not supposed to be on any anti-psychotic medication because someone who doesn’t have a mental illness has an allergic reaction to every single one. Trauma and Torture is not a mental illness and needs to stop being treated as such. After the nightly physical and sexual assault during the day I organised calling any one.  Anyone who was sain. Joined me at the fence, chanting and crying “let me come home to my people. Freedom.” I also held a hunger strike for the entire four days only eating oranges until they let us out.  I chanted day and night I didn’t shut up until they let us out. They finally realised after they witnessed me being physically punched and kicked repeatedly they had made a grave error that I had every right to occupy for Equal Socialist Alliance and CAAH rights to stop the AVO like any rational person would do for their people.  It was just a normal understandable double bind reaction protest in response to the AVO.  That had no truth to it. That we were fighting for equal socialist alliance, resistance, Green Left weekly and CAAH rights which is also my replacement family. That we doing that by fighting for our people to know the truth so that amnesty could be called.

182.          I went to the Green Left Weekly dinner and invited the Humanist Party because I figured an immediate strategy of socialism and human was needed with a World March for Peace and Non Violence. Alex blamed Rachel and Rachel blamed Alex for the order. Comrades supported the world march for peace an nonviolence. The Humanist Party realised they had made a mistake by holding the organising meeting during the Walk Against Warming because they didn’t listen that people won’t come if you hold the organising meeting the same time as a big rally because the people will all be at the rally including myself.

183.          After almost 12 months of Rachel’s authorisation being used to gag every elist and continuing having to send request after a request for the gag order to be lifted using an old access code Rachel  Evans had given me to use in emergencies prior to November 2007. A death order using Rachel Evans power and authority over me was about to be legalised. Hundreds of people’s lives were going to be carrying this out being duped into believing it was a majority decision when it was a couple of honourable judges not even realising it’s the guilt fix method combined with a social cause of bastardisation using Rachel authority and power over us while a false history would be created the next two years where one was about to be put through some of the world’s most inhumane cruelty just like the refugees we had to get the truth to our people. I didn’t know if I was going to survive it.

I called another workmate/ friend - John Coleman - of Evans and myself and told him to check this out. I called Evans and told her. She had a meeting at that office that she was on the way to. She said she would call the police if Dahl was there.  John Coleman checked inside the centre and discovered Dahl inside. Coleman and Evans called the police and the police took her out of the centre and placed her in the Cumberland Hospital mental ward for two days. Evans was distraught and could not be alone in the Western Activist Centre for a month. She has requested moving offices because of the stress Dahl has placed in her.

Section 1.25    November 2008 Occupation at the AIDs war memorial

285.          We occupied the AIDS war memorial we were again sent the invite and we went. Rachel took her anger out on me for coming and I was scared. Allan Priestly tried to pull me to see speak with Rachel but because it’s a place where lgbti people have sex wrong time and wrong place. If it had been in a public place or the activist centre or UTS or a community justice centre no problem. I would have said that’s awesome relief  let’s sit down together to work out ways to politically resolve this. It would have only fuelled Rachel to have argued in court it was an wanted sexual with her or homosexually assaulting me  with her instead of a political discussion about stopping the order. My gut told me it was a trap. Alan Priestly had convinced Rachel too easy and too quickly. I just kept saying over and over Yes Rach and I need to talk about resolving this but not here because I don’t want a sexual relationship with Rachel. Under normal circumstances with no AVO I wouldn’t have had any problem having a political discussion about resolving an issue. I knew there was a risk of this being an ex-gay program. A big part of the experience certainly has been like that.

286.          In the lead up to the hearing  in Court Rachel personally attacked me and the guilt fix method was used on me by suggesting to her that she wasn’t a lesbian simply cause she had long hair. I never told Rachel that. When I had left a note at the time it was to cut the crap and lets meet together to resolve this. I had had long hair when I was a teenager because Marion had insisted it be short due to nits and I got targeted. As an adult I personally didn’t like having long hair as it was too much maintenance. So even though I personally like having my head shaved I grew my hair long to stand up for the rights of other lesbians to have long hair. Even tears won’t stop not because I personally am itching to shave it off. Love of the living humanity this desire this yearn meant driven from the heart it’s not a sexual desire it is a revolutionary desire. My tears won’t stop not just because my whole body for the love of the living humanity is in intense burning, throbbing endless suffer torturous physical  pain from the effects of the AVO order power and authority over me  yearning and fighting for freedom the return of life with political rehabilitation and not legal condemnation order for full equal socialist alliance, Resistance, GLW, Resistance and CAAH rights for you to stop torturing me and just let me go in there and give comrades and CAAH the truth. The harmful effects of the guilt fix method combined with communication and place restriction via an AVO using a leader’s power and authority over a person out way any benefits.

287.          The majority since November 2007 by both Rachel, Alex and the judicial system Rachel’s AVO power and authority combined place and communication restrictions over me has continued to deny the majority the right to trial and test me in their presence. If they were permitted to hear it from me in person with Rachel’s AVO power and authority over me being used to stop it they would see the lengths and sacrifices I was making and will go to for the party and the people. Like doing what I don’t want to do by not shaving my hair for the rights of other lesbians to have long hair until her AVO is revoked and Rachel retracts her comments and stops using the guilt fix method on me an amnesty has been called and full equal socialist Alliance, Green Left Weekly, Resistance and CAAH/Equal love rights have been restored. It’s a political reason it’s not personal and definitely not doing it to make myself look good or to point score. It’s just driven by love of the living humanity for the party, CAAH, the millions.

288.          My replacement family and my replacement house. They were pictures of comrades, CAAH which include me  and every politically organised human rights struggle as an important part of the revolutionary struggle. Our rally pictures are our family portraits. The ones with all us at the activist centres is our home. Rachel just organised the launching of the court case. When a person is an accused person under the judicial system they don’t have a choice except to occupy the courts to fight for freedom. I tried organising through normal political party and CAAH trial procedures and processes  I continue to fight for that but every effort Rachel shuts down either herself or through one third person after another and redirects it back to court. I hate court but it is the only avenue Rachel will permit me.

Occupy the Courts 2  Legalisation of the original APVO

289.          On 5 December 2008 the APVO using Rachel’s power and authority over me was granted and proposed to be legalised for 2 years at the Burwood Local Court as a result of not being permitted to give evidence which just expected to except whatever I was accused of.All the witnesses were not permitted to give evidence including myself. I was only permitted to ask questions and provide written submissions. In terms of a verbal testimony of the history from start to finish without interruption and a solution by way of mediation to sit down at a round table. It wasn’t about negotiating for concessional rights or agreements but simply just to meet to organise a civil political trial as an alternative to a criminal trial by which equal rights and agreements would be fought for through that means. It is a lie for anyone including any Honourable Magistrate or any lawyer to tell any defendant they are not admitting any sign of guilt nor will receive any sort of punishment if they just accept an APVO without any hearing or trial on the matter because of the prejudice and ignorance of police and the community’s lack of knowledge that not all AVOs are genuine. It is essentially a jail sentence with no trial or hearing of the matter where every defendant who has ever had an APVO on them is expected to just remain silent and accept whatever their accused of tolerate whatever inhumane treatment they receive while job, education chances for rehabilitation are severely reduced and not be given a go to prove otherwise for the duration of the order.

290.          Rachel Abused her position of power and authority over me. The lawyer walked out when we were very close to defeating it because I wouldn’t take the concessional deal of 30 metres. Then the Magistrate put forward an offer of no place restrictions on the activist centres and no 100 metre. But that still meant no communication with anyone and no organising the equal marriage campaign while expected to remain silent, held a prisoner. Made an illegal human just to be tortured for seeking asylum with my people. All I was permitted to do was ask questions but not give any evidence to show the allegations have been false, created a false history of me, torture and the guilt fix method. I wanted to give evidence but it wasn’t allowed to be heard that would have stopped it. Other comrades of mine weren’t allowed to give evidence and neither were concerned citizens.  I thought at the time by standing up for the rights of other victims to speak out would help stop the order. I thought by defending the right of victims to trial their own accused would help call an amnesty. It was literally like being shot in the heart. If it hadn’t been for Comrade Melissa Hughes I would have died that night. Not because she was my former girlfriend but because she is my comrade who came. The truth wasn’t heard and I was left with no choice but to launch an appeal through the court system for the following to be heard.

291.          I pursued a revolutionary relationship with Rachel not a sexual one. For Rachel or anyone to have continued to insist sexual instead of revolutionary from me with Rachel to justify the AVO is offensive, insulting, bastardisation, torture, homosexual assault, the guilt fix method and inhumane of me. It is the guilt fix method. It has been is homosexual assault of me by APVO since November 2007. It has also been like an ex gay program between lgbti comrades and me. Lesbian comrades we are uncomfortable with each other. Lesbian comrades prior to the AVO we had an incredibly strong sisterhood going on where we would look out for each other, cry on each other’s shoulders, give each other a hug, laugh, guide each other, listen to each other, talk politics, organise and pull each other up without condemnation of each other and give each other a back massage after a big rally. There was nothing sexual about it. Since November 2007 with this AVO with every lgbti comrade yet specifically with lesbian comrades it’s like seeing Rachel my mother homosexually assaulting me and were constantly scared of each other. No means no from me to unwanted sexual advances. Always has always will. Rachel you didn’t listen, The court wouldn’t let me explain it and everyone including me is hurting everyday your AVO exists since November 2007.

292.          The words I love you is not a sexual advance. The words I love you means love of the living humanity by Che Guevara. 

293.          LGBTI comrades do not join political organisations to pursue personal sexual relations or advances with LGBTI comrade leaders like Rachel. We work together closely because there are very few lgbti comrade organisers. We don’t have time to hold grudges or blame each other or condemn each other or to personally attack or name call or use the guilt fix method or fight with each other. We only have time to include each other to organise and talk about political solutions together to get the work done together. There is also another reason why we don’t have time to go against each other. Human life gets killed by pitting people against another person. I don’t go against people I fight for people. Rachel You didn’t listen, the court wouldn’t let me explain it and everyone including me is hurting everyday your AVO exists.

294.          I am the only LGBTI comrade that I know of who is also a white stolen generation. Former ones I have spoken with agree we see comrades as our replacement of the family. Rachel is our mum and Karl Hand is our dad all the rest of us are sisters and brothers or whatever label people want to see themselves us. Farida likes to see herself as a 65 year old grandma on Facebook and likes saying “get off my property” like a granny does but we’ll leave that one alone for now. Just tell her don’t go telling mental health or they will lock her up. Rachel You didn’t listen, the court wouldn’t let me explain it and everyone including me is hurting everyday your AVO exists.

295.          Uniting with the majority and fighting to do that is not stalking, an obsession. I called you cause you wouldn’t let me come to work and let us all make that assessment together. Rachel either personally or would use third persons to block the door. Anyone can get framed if you don’t give people a go or one gets cut off during a very important testimony that hundreds of thousands of lives are counting on. I tried but you shut it down with the guilt fix method, homosexual assault of me by AVO, place and communication restrictions, discouragement, anti-socialcomradely behaviour and language , aggression, threats to my life, constant over use of power and authority over me, condemnation, bastardisation, torture, taunting, name calling, discouragement, interference and using and inciting others to commit acts of hate. 

296.          Suicide and self-harm the majority of victims don’t have a death or harm for any human wish. Self-Harm such as cutting is caused by acts of blame received from others. Suicide is the double bind guilt fix method combined with a specific social caused prejudice. Usually triggered by alienation from the capacity to communicate by others.  People are told to die from others behaviour and language towards them A political rehabilitation strategy and not condemnation strategy of inclusion and encouragement with the majority with love of the living humanity is best . What happened in the SRC caused suicide as a result of it removing Resistance.

Section 1.26    Conversation with Mel Hughes.

297.          Mel Hughes had contacted me to see if I was okay because my life had been put at risk with Rachel’s APVO power and authority over me now legalised. If she hadn’t contacted me to continue the struggle for equal socialist alliance and CAAH rights I most likely would have died that night. I was told by both the police, comrades, CAAH and the courts that I had to go through court in order to annul it. My choice I was given was to either tolerate it or to lodge the appeal to annul it through court. I was also told to lodge a cross claim to protect my human rights under the APVO. I didn’t want to go through court but I was told that was my only option for this campaign. Under the APVO I risked getting arrested and tortured if I didn’t go through court to annul it if a charge got made. If a charge got made I risked getting arrested under the bail act of 2007 if I didn’t go to court. Due to the nature of the restrictions with place and communication right in the heart of our party and the queer struggle. This essentially meant I would have to walk around with tape over my mouth. To put a restriction of “Do not approach or contact where the person from time to time works or resides except via the persons legal means” essentially meant the entire country is essentially illegal for me to be in because socialists work and reside to organise campaigns everywhere with the only option being court. It doesn’t matter what distance.

Occupy the Courts 3  The First Court Appeal Parramatta District Court

298.          On 9 December 2008 I appealed to the Parramatta District Court to fight for equal Socialist Alliance and CAAH rights because the truth wasn’t heard. The right to defend action includes the right to appeal. If the APVO hadn’t gotten legalised I wouldn’t have had to. I had two choices do what I was being systematically told to do by use of Rachel’s power and authority over me that I didn’t want to do. Rachel had a choice because she held all the power now. I had nothing to lose but the AVO because we had equal party and CAAH rights to win.

Section 1.27    10 December 2008 International Human Rights Day

299.          I went to the International Human Rights Day protest. Rachel was dumbfounded to see me. Yet my philosophy is the first step in any campaign is defending the right to protest even if you’re a prisoner and have to where tape over your mouth. Maintaining Proletarian Internationalism stops a revolutionary going backwards.

300.          The result at Burwood followed immediate disciplinary action. People who entered the trial now were thoroughly examined. Alex resigned from his post at central and went to Occupy the Perth activist base of Socialist Alliance and since I was incommunicado Rachel was sent to Occupy Mexico until August. 

Occupy the Courts 4  The First Cross Claim Alex Bainbridge

301.          The accused as a result of the AVO became the accuser and those who came to accuse me now found themselves accused. I did what I didn’t want to do I lodged a cross claim on Alex Bainbridge who argued that these were vexatious and frivolous claims. I don’t have time to make vexatious and frivolous claims because I’m too busy organising instead of agonising. I had had enough.  Alex stupidly allowed Rachel to come with him and sit with the people when I’m supposed to be a threat to her. It was before the same magistrate too. I didn’t want to do it but Alex didn’t leave me any other choice. I was hoping he would take responsibility and help clean up his and Rachel’s mess for the Alliance and CAAH. I won the right to continue paying my financial dues to the party and CAAH. Yet again this time Alex put forward a plane ticket to Perth and I was promised it would be all Oranges and Sunshine and again I was left to clean up the mess.

Occupy the Courts 5  Parramatta District Court

302.          On 5 & 27 February 2009 The Honourable Judge placed a stay instead of outright revoking it. Again Rachel Evans had decided to take another holiday to Mexico and was told I had to wait for 8 months and I was promised it would be all Oranges and sunshine upon her return with an annulment after a fair hearing on the matter. The Honourable Judge granted us the right to return to work and sit with the defence to help organise campaign like the NDA. I was the poor bastard who was left to clean up the mess. I have attached the letter from the Parramatta District Court.

303.          February – NDA August 2009 the Stay period. Comrades and CAAH didn’t realise a stay had been placed on the order. The first taste of freedom since Nov 2007 and 5 whole months of no Judicial system court and no legal place or communication restrictions to stop us from uniting with the majority. I was looking forward to it. This was a chance to stop the AVO like we stopped the overseas same sex adoption ban with complete non-interference of the state during this period and fight for my replacement family. This was a chance for comrades and CAAH to trial and test us through normal political party and CAAH trial procedures and processes. We knew there might be a bit of mess we would have to clean up but it didn’t matter to me I was going home for 5 whole months with my family. I knew exactly how Villawood refugees felt when they got out of Villawood. Street Level threw a huge party too cause it was a win not just for comrades, CAAH or me but for the poor. I hoped to receive political rehabilitation and not personal condemnation orders. I was also scared at the same time cause I knew I would also witness the full extent the AVO damage had caused that the work would begin cleaning up the mess. I also received this email from a Louie Weber 27/2/2009 which I agreed totally with. Yet while I have an idea who it might be from it not matter. It stated:

309.          So my first task I was going to call for an immediate special conference for the appeal to be heard.

310.          Our first task before celebrating is to find that AVO motion. We went straight to the Western Sydney Activist Centre. We found it was Alex Bainbridge who had met with Graham in secret. Then one person from central used Rachel’s power and authority and the DSP power and authority over me and told around 10 people in the DSP to implement the AVO on Socialist Alliance & green Left. The Socialist Alliance, Central office, Resistance, CAAH, the majority of the Green Left Weekly staff, myself and Rachel. What were Rachel’s consequences if she didn’t legalise this AVO? All we had was more questions. Why was no independent investigation conducted before acting? Was the set up done before the majority and Rachel because they knew it would be stopped when they got back from holidays? I had never had a bad report in the party or CAAH. Why did Alex not accept learning from us about the struggle for the rights of the white stolen generation? He had said Rachel would be pleased about this. I had said no she wouldn’t.   We were indeed set up just like my guts and heart told me. We had the 5 or 6 pages photocopied and went and returned the two handwritten notebooks.

311.          So I went and Occupied the Chippendale activist centre. Brianna, Viv used Rachel’s authority and abused me with the AVO guilt fix method. They also told me Rachel wants an AVO they wouldn’t stop with the torture but I kept telling the truth. These comrades never acted like this prior to the order. Comrade Peter Boyle had a little more common sense and offered a range of suggestions to help. I told him I tried that but I wasn’t being listened to. Comrades rebelled the Stay and carried out the AVO on me. They also told us to wait until Rachel gets back and go through the court system. Briana called police. Police reaffirmed there is a stay on the AVO and for comrades unless there was a real emergency to stop calling triple 000 on me.

312.          Financial dues/membership/sales/subscription to Resistance, Green Left Weekly, Socialist Alliance, CAAH broke through Alex’s wall and were accepted

313.          Fair Day Rachel’s AVO incited Chris Manserg to personally attack us for distributing Equal marriage petitions and doing stall work. We spoke with CAAH who had said to wait for Rachel to get back.

314.          Mardi Gras- We marched with the Sydney Gay Atheists with tape over my mouth

315.          CAAH mtgs. I proposed a mass illegal wedding for the ALP conference.  Rachel had organised with Alan Priestly to greet us with security on the first meeting they just comrades hadn’t woken up there was a stay on this and was just exposing this was illegal to violate one’s civil liberties for coming to a CAAH meetings to unite with the majority to help organise the NDA. The guilt fix method was used on me by Alan P, Matt and Maurice incited by Rachel Evans APVO power and authority over me. They personally navel grazed about me, surrounded me and bullied and tormented  and targeted me. I again just stood there with the power of stay in my hands saying over and over wake up. Allan Priestly let it slip Rachel had organised it before she went to Mexico to use delay tactics as was told to wait until Rachel gets back. Alan Priestly and Matt threatened my life they told me to hurry up and do it. Security interfered when CAAH and myself began talking about what it’s important to organise together to win equal marriage rights. Even though I was scared, I said, “Not the church . Not the state. Queers will decide their fate together.” Maurice smiled. That was when I realised not everyone who carried out the order wanted the order.   When Matt and Alan Priestly stopped screaming at me I went up to Alan Priestly and asked why are you doing this when your just like me? Alan Priestly denied who he was, “When is our chance going to happen if we just stay in the closet while leaders force us to say nothing while we do everything? The fight for the queer white stolen generation/orphans is just like the queer struggle 30 years on. You as a 1978er who is also a queer white stolen generation just like me with your experience should be supporting this fight for our lives here, not bastardising me or using the guilt fix method or calling police because Rachel or any leader told you too. You should be calling for an amnesty but instead you call the same police who locked and smashed queers up for their sexuality and gender 30 years ago because queers were literally deemed illegal citizens by our own country.” Police arrived who reaffirmed the stay and alerted CAAH to stop calling 000 on me for us to sort it out ourselves.   Maurice turned to me and said do you see the problem? I said, “I put that question to you. Do you see that the order between us is the problem and not each other? Rachel will ram this through if we don’t sort it out now together.

316.          We got two organising meetings. It wasn’t enough to organise the NDA because they said just like comrades and CAAH and the Honourable Magistrate to wait until Rachel came back. Alex never waited.

329.          Over 5 or six of us including Stewart BaanStra came. CAAH had asked Alan Priestly to step down from co convenor. Alan Priestly and Matt Hawe had threatened to quit like they normally did. Ben Cooper retracted his email and told us that no meeting had happened he was just told to send it. I continued to come but all we got was two organising meetings. We helped CAAH pick the most direct and open March route. We had proposed a mass illegal wedding call out at the ALP conference.

330.          The same sex marriage race. I came to the stall. Rachel took her anger out on me for coming and threatened the police. I told her, if you don’t stop yourself, then I have to do what I don’t want to do and put an AVO on you. Rachel stopped and said, “you wouldn’t.” I said you don’t leave me much choice. You haven’t listened to the solution to the warnings. You wanted to go down the court path.  I just said a conference for the people to decide after they’ve heard the truth. We call it amnesty and then we all move forward together with political rehabilitation and not personal condemnation.  Rachel wouldn’t stop. So I just reached into my bag said nothing and held a sign up calling for inclusion of queer white stolen generation revolutionaries with the majority organised equal marriage campaign. Emila just stood there with a big grin on her face. Rachel was lost for words just staring at the sign. Then I picked up a petition, leaflets and talked to people to come for the NDA.

Section 1.29    NDA 2009

331.          – The NDA 2009 was the biggest we had helped to organise.  I had picked the simplest and most direct route with the most exposure through the complicated maze at Darling Harbour. Queers always wondered how I could see the solution through all the “Mérida” so quickly when they would have to spend hours and hours deciphering the correct solution route between point A to point B. When I was in high school they used to call me Sherlock because of it when they asked. I just used to saymaybeit’s because of all my years when I was a child I spent finding cans and bottles through the trash on weekends because Marion needed the money I don’t know I just see what they don’t see.

332.          We went to NDA. I just stayed focused on the rally. I wanted to talk with our people I didn’t want to talk to Rachel at the time.  The  Rachel that met mejust like the one that came back from Bolivia just like the one when in the November 2007 meeting was not Rachel. I had asked Alex when I first got out of detention whether there was something wrong with Rachel because she’s not herself. She was angry all the time. The mass illegal wedding had mobilised over 10,000 people. I went to ask Karl Hand to change the chants because Ben had asked me to. Rachel committed verbal homosexual assault of me and then threatened the police and then laughed. Ben Cooper witnessed it and said, “Yeah I see what you mean, it’s like the AVO causes her behaviour and language to switch into someone quite scary and the people don’t even see it. How long she been like this?” “Since November 2007 when the guilt fix method first captured both Rachel and Alex from one person to the next and they started giving it to me.

Section 1.30    Socialist Alliance State Conference 2009.

333.          I went for the appeal to be heard. Brianna screamed at me and slammed the door and part of my arm got caught and I cried from the pain. Comrade Viv came out and I explained that there had been a frame up she had no idea what had happened. Viv saw how much I was trembling from the injustice which had been done to me that I was blamed for doing something about it since November 2007 and how much the AVO had tortured and agitated me that much into action to fight for comrades to know the truth. Viv was the one who told me if I didn’t call the police then she would. I had never called the police on comrade leaders before. I didn’t want to. The police came and Viv told a half truth that comrades do want us to come in to hear the appeal but was considered too sick to stand trial. Here I was ready to be trailed that we don’t have to do by a court of law what are you waiting for? I was told wait till Rachel comes back.

Occupy the Courts 6  First Cross Claim with Rachel Evans

334.          On the 12 August 2009 I was left with little choice but to apply for a cross claim at the Burwood Local Court. I had tried to see comrades for political advice and to resolve it but they told me to wait till Rachel gets back or to go see Rachel to sort it out with her. I had tried to see CAAH for political advice and to resolve it but they had told me to wait until Rachel gets back from holidays. So I just went to work and thought by doing political work she would wake up when she got back from holidays and embrace the banner of freedom but her use of the guilt fix method on me continued. I had tried to see her lawyer Mulley Roth for legal advice on organising a meeting for a civil trial but he had disappeared. We both didn’t have lawyers. Rachel stated in that court case that I liked going to court when I hated court because I’m not a lawyer, I don’t profess to know everything. I just know ”Mérida” and injustice and investigate to find the political solution coming rather than convictions when I see it. 

335.          It wasn’t against Rachel it was a result of the violent and prejudicial actsI received from Rachel Evans AVPO power and authority over me in the fight for equal Socialist Alliance and CAAH rights for the appeal to be heard to annul the order. I removed place and communication restrictions not for some obsession but to allow her the space to focus politically on resolving the situation rather than continually personally navel graving about me with untrue “Mérida” to stop scaring me with her APVO power and authority over me. It was done in consultation with the people the duty registrar as well as informing Rachel in person myself that she was leaving me with no other choice because she wouldn’t stop and just call it amnesty and just let me go to work and let the people decide for themselves after hearing what I’ve got to say in response to these charges regardless of whether she wanted to help or not.

336.          I don’t condemn people simply because I am being wrongly condemned. I had to pull her into line because she was out of control with the number of overwhelmingly irregularities she was committing against an accused person. She’s been so blind to the 24/7 inhuman injustice being committed on my body as a result of her order everyday it has existed. I told her I was going to do what I didn’t want to have to do if she didn’t stop. I’m a human being, I’m not a machine and there is a limit to tolerance of constant inhumane acts I receive as a result of her AVO 24/7.  

Occupy the Courts 7  My 1^st Appeal

337.          On 17 August 2009 The District Court had plans to squash Rachel’s AVO. On the 17 August 2009 Rachel Evans was served with my cross claim. I was willing to withdraw mine if Rachel was willing to withdraw hers even though were scared of each other to go to a community justice centre to work out a solution we can all live with.

338.          On 25 August 2009 my appeal yesterday as it is today is for our people to hear the truth in the fight for equal Socialist Alliance and CAAH rightsfor amnesty to annul the order so we can all go home and get on with the task of the revolutionary struggle to change the world. Rachel turned up and all Rachel had to do was again tell “Mérida” about me even though it wasn’t true and the Honourable Judge believed her. I tell the truth and I don’t get believed. They had also switched honourable Judges. Again I was denied the right to submit evidence. Again despite overwhelming evidence I never went to Rachel’s house during the stay period when I legally could have I was not listened to. Again despite overwhelming evidence the allegations created a false history to bury the injustice that happening to me  I was not listened to.  Again the truth wasn’t heard because Rachel told “Mérida”and committed bastardisation acts right there in the court room. Again the truth wasn’t heard that this AVO order by use of Rachel’s power and authority over me makes one an illegal human. Again it wasn’t listened to that it made it illegal for LGBTI comrades to organise lgbti campaigns to win equal love, equal marriage and equal world.  Rachel’s rationale for showing no common sense and just calling it amnesty so we can all go home was followed by personal attacks with no political debate that she organised the court case and wasn’t going to pull it out of the court system.

339.          The Honourable Judge highlighted Rachel had been in Mexico, but even though Rachel couldn’t really explain her actions the order went ahead because Rachel wasn’t prepared for her to work in one Socialist Alliance base and me to work in another Socialist Alliance. The honourable Magistrate looked at Rachel and said she would have thought common sense would have prevailed. I have again attached the transcript.

Occupy the Courts 9  Interim Cross Claim Granted

340.          On 28 August 2009 the Burwood Local Court Magistrate granted an interim Order on Rachel Evans because there appeared to be indications Ms Evans was abusing her AVO power and authority over me. This was in relation to my cross claim dated 12 August 2009. This matter was ultimately set down for hearing on 22 March 2010. Again it wasn’t against Rachel it was to give her the chance to explain her actions and for protection from violence during the course of this campaign for equal Socialist Alliance and CAAH rights. It was to address the issue of Violence that had resulted from the 1^st APVO.

341.          I wrote the first draft of the History of the Road to Rainbow liberation except I didn’t have a title for it at the time. It is now complete with my other comrade’s political writings.

342.          As a result of the AVO I was left with little choice but to text Greg for a meeting to work out an avenue other than court for our people to hear the appeal.

Occupy the Courts 10                      Gregory Rowell’s charge resulted from the AVO 8/8/09-1/11/09

343.          On the 8 August 2009- 1 November 2009 Gregory Rowell’s charge resulted from Rachel’s AVO that was to determine my communication and my life. The H number is H40012165. I had called for help for our people to hear the appeal.It was Use of Carriage Device to Menace Harass Offend. The matter was set down for hearing for 8 October 2010.

Dropped charge 1)        SOS calls to help each other in organised campaigning work out is not a criminal act. 

344.          On 8 October 2010 I was found not guilty.I was represented by a lawyer Jeremy Rae but denied the right of other witnesses from speaking that I had subpoenaed. The Honourable Magistrate at the Ryde Local Court found us not guilty for the following reasons. There had been an AVO in place that resulted in prejudice developing in Greg and not giving us a go. That we were justified in calling to meet to resolve this for our party and CAAH because of the amount of injustice the AVO was causing. We were legally recognised and a Socialist Alliance and CAAH person.  That if one is in trouble one has the right to use their phone and call for help from people they trust. We also did what we didn’t want to do and took out a cross claim with Greg because he wouldn’t stop using Rachel Evans APVO power and authority over me to bastardise me. The Magistrate quite rightly ruled he found it hard to accept that not letting us come to work to addressing any appeal through a civil trial instead of a criminal trial to help resolve a difficult situation so I wouldn’t have had to text for help for a just cause such as equal Socialist Alliance and CAAH rights for life because Greg, “Didn’t think it was important.” Greg wouldn’t have had been elected a co convenor of the western Sydney Activist Centre if I hadn’t come to the party in the first place because the Western Sydney Activist Centre it was dead where there was only the germ of socialism before I came along and the LPF weren’t doing anything about it. Now it’s a lively active base because we dared to dream, dared to struggle and dared to win. I always had a strong philosophy if I was uncomfortable it meant I had to do something to change the situation and I haven’t been comfortable with the  APVO using Rachel Evans power and authority over me since November 2007.

345.           The price I paid was $500 for subpoena’s because I faced arrest if I notified in person as I would about any organised political human rights campaign action regardless of whether I was one of the organisers or not under normal circumstances happening outside of the judicial system. Under a secondary gag order for 12 months and false arrest and false imprisonment while the AVPO continued using Rachel’s power and authority over me kept building a propaganda lie campaign to insight hate and prejudice within our community.

Section 1.31    January 2010Socialist Alliance National Conference.

346.          Comrades do what I did in Paragraph 76 in January 2008. Comrades seem to realise it wasn’t such a crazy or suicidal idea after all and they resigned from the name DSP and merged into the Socialist Alliance.

347.          I was detained on my way there in search of two independent psychiatrists for 6 weeks where I was tortured, redbaited, physically, verbally and homosexually assaulted who kept putting pressure on me for 6 weeks to accept I’m too sick to stand trial. I knew exactly what I was doing with concrete factual evidence of everything I have written which had happened between my people and myself and what I am fighting for actually occurring because I had witnesses who wrote affidavits and support letters who saw what happened, who saw this was genuine an not some conspiracy theory. I don’t believe in fantasies, conspiracy theories or other such nonsense. I work with concrete facts of what happened to everyone involved and offer the political solution to resolve it. It’s part of revolutionaries job to listen to the people’s woes, know when an injustice is occurring, what is “Mérida” and what is truth, finding out both sides of the story with the solution revealing itself that the majority of people want to do politically to organise a campaign to stop it with a solution we can all live with.

348.          I went on a hunger strike living mainly on Oranges for the majority of the period  in response to being detained from that conference until they let us go back to the fight for Equal Socialist Alliance, Resistance, GLW rights. My body strongly resisted all drugs except for vitamins. We didn’t stop protesting even after they let us out because they had put a CTO in place. The community said they’ve drugged me to keep me quiet. We lodged appeals after appeals after appeals and showed continued Resistance to accepting any order which interfered with the fight for equal socialist Alliance and CAAH rights. Two independent Bulk Billing Psychiatrists assessed me both on the drugs and off the drugs when I came back from Melbourne.

Section 1.32    Mental Health system defeated. My health declared excellent.

349.          They declared my excellent state of heath and that I never was mentally ill after examining all the evidence. That it was just a nervous breakdown over the SRC. It was those drugs and the mental health systems interference were very well most likely a contributing factor which caused this situation. It had done damage to my nervous system and I needed to take Vitamin D and Fish Oil with no other drugs to repair the damage done from the drugs from the mental health system’s and judicial system’s interference using Rachel’s power and authority over me based on their opinion and not on fact. Dr Heint had stated if you put a normal person on anti-psychotic medication to recover from a trauma and torture of a life threatening event as well as isolate them for an understandable and perfectly natural reaction to a double bind social caused situation you effectively giving them both a chemical lobotomy and are damaging their nervous system. That antipsychotic medication should always be a last resort as there are many cases where they people are having a double bind reaction to an injustice which is not a sign and symptom of mental illness. He also agreed that you don’t give medication to victims of suicide after admitting them for an overdose because when something happens they will just overdose on them. You instead teach them how to stop the injustice that is being fed into their mind by others language and behaviour towards them. Dr Heint had a very good understanding of political activists and revolutionaries. He only supports the greens for his daughter but supports Socialist Alliance. He works very much with Marxist theory on the failure of psychiatry to understand political activists and revolutionaries that it is normal and natural behaviour for us to fight to unite with the majority and to organise political campaigns to stop injustice to fight for human life. That we work in a highly stressful occupation. He in  fact said he would be very concerned about me if I stopped organising political campaigns to fight for equal Socialist Alliance and CAAH rights to give my people the truth via any appeal means to annul the AVO as an important part of the revolutionary struggle.

Occupy the Courts 11                      1^st hearing of the cross claim

350.          On 22 March 2010 not all the evidence was permitted to be heard and again I didn’t get to tell what happened from start to finish of the history of this struggle because the Honourable Magistrate had no patience. When we have forums and political events and rallies people who’ve nominated to speak even accused persons are given the courtesy of saying what they have to say without interruption. The only time they are interrupted is if they have said something prejudicial or personally attacking or hearsay.What was revealed is that I am being homosexually assaulted by AVO by use of Rachel Evans power and authority over me from day one because of the refusing or other to accept no means no from me to unwanted personal sexual advances. That simply because one can’t accept place and communication restrictions combined with the guilt fix method on the revolutionary struggle by continuing to go to work and study for the majority of people even though a few leaders tell you not to is not an indication of stalking, harassment, obsession or a unwanted sexual advance. Those words all have one thing in common doing it with the intention to cause harm to others human life. Fighting for equal Socialist Alliance and CAAH rights is a good thing. Fighting for people to hear the truth that can resolve a situation is a good thing. Fighting for political rehabilitation orders to defeat personal condemnation orders is a good thing. Fighting to unite with the majority for all live is a good thing. Revolutionary advances is a good thing with civil disobedience and direct action for the right to rebel orders of tyranny is a good thing. All healthy and not criminal responses. What has been unhealthy is the AVO which uses Rachel’s AVO power and authority over me to build a hate and prejudice campaign towards uniting with the majority.

351.          March – June 2010 Melbourne

352.          I decided to go to Melbourne with the hope of a fresh start and because I needed a break from the AVO.

353.          It is a well-known fact that other bases were the least affected if at all by the order because they had no knowledge of what had been going on in Sydney and Parramatta since November 2007.

354.          I told Melbourne. I successfully entered Melbourne Activist Centre, had a discussion with Auntie comrade Sue Bolton who had agreed to give us a go. Rachel’s APVO power and authority over me from Sydney stalked me, interfered and shut it down. Sue let me help anyway. It was pretty much agreed I had to go back to New South Wales and revoke the order rather than spending time in another state until it expired because the AVO followed me no matter where I went in Australia with Socialist Alliance or queer political organising collective which organised the NDA.

Occupy the Courts 12                      Appeal of 1^st Cross claim

362.          On 20 May 2010 I filed an application for leave to appeal to the District Court to proceed with the cross claim in response to Honourable Magistrate McGowen dismissing it in the Burwood Local Court on 22 March 2010. The appeal got interrupted so was never fully heard and was dismissed in the Parramatta District Court.(See paragraph below) I help organise campaigns instead of agonising about individuals and situations to fight for things and for people’s lives to change the system we live under.  I don’t fight against. It is a well-known fact everyone knows I don’t support Rachel’s AVO. People want to know what we’re fighting for. Well everything and everyone to win a revolution. Yet specifically Socialist Alliance equality and CAAH equality and for an appeal for the truth to be heard by our people and the court to annul the order. Rachel and the judicial system won’t let me go through our normal political party and CAAH trial processes due to the order. I tried and Rachel via third persons or the police shut it down. So I have to do a combination of both. It was about the same time the repeal campaign become the fight for equal Socialist Alliance and CAAH rights or Socialist Alliance equality and CAAH equality. The History will absolve us name was the correct slogan for the name of this campaign that had the most popular support for what to call it.

363.          There were many charges that didn’t make it to court that Rachel made in abusing her AVO based on her “belief”. I subpoenaed all of the charges that resulted from the APVO, and investigated to see whether others had made charges I wasn’t informed about as a result of the AVO. There were seven from Rachel Evans, Two from Paul Benedeck and one from Gregory Rowell. I also subpoenaed my history. There have been only three convictions with seven charges dropped.

Dropped charge 2)        Apocryphal religious leaflets

364.          On 28 May 2010 while I was busy with the Melbourne contingent for the NDA for abortion rights Religious leafletsabout God was allegedly put into Rachel’s letterbox. Event number E41310407. The leaflet stated that I was the author of the work even though I have no history of writing religious leaflets about God because while I accept spirituality I talk politics. No witnesses saw me put it in Rachel’s letterbox nor did this alleged leaflet have any direct communication with Rachel. While police used their common sense in that instance because there was insufficient proof and took no formal action. While Socialist Alliance is my faith and Rachel is an atheist although I heard at one point she got involved in scientology that I could have told her was a scam. Religion is the opiate of the mass. Sure I talk with the Christian left and mingle with the poor Christian left cause it helps keep my faith in Socialist Alliance and the majority of people as that’s where the poor mostly hang out I’ve never written any documents about religion. I just talk politics and encourage them to put their prayer into action for revolution on earth rather than just praying for one. That’s where I learned what the Christian left did amongst the poor to defeat the guilt fix method since 2008. Che said it was elementary logic to unite with the poor so I did.

Section 1.33    National Day of Action for Abortion Rights

365.            I was on a train coming back with the Melbourne contingent at the time we had been organising for the National Day of Action for Abortion rights to drop the charges on the Queensland couple for using the abortion drug RU486 with Campaign for Women’s Reproductive Rights whose politics I didn’t agree because they weren’t Socialist Alliance politics at the time.

366.            The Freedom Socialist Party

367.          They didn’t listen that the political is not personal of the equal queer struggle. They didn’t listen that its Marriage Equality not same sex marriage. Same sex marriage is only gays and lesbians to the exclusion of trans, bisexuals, intersex etc of all the alphabet soup in our sex and gender diverse rainbow community. They didn’t that as an organiser from the Marriage equality campaign has revived the queer movement. They didn’t listen that repealing all abortion laws will not lose what has partially been won in Victoria. The reason Freedom Socialist Party is like that well its cause Socialist Alternative won’t let them into any organising meetings across all the movements, especially the queer movement. You can see it in their paper Socialist Alternative targeted them so they target Socialist Alternative.  Green Left Weekly is all they got to be rehabilitated by. 

368.          I learned about the Freedom Socialist Party through Green Left because they were doing educational on the queer struggle. They lost me after they suggested the political is personal and that the queer struggle is not as big today as it was over 30 years ago. I took them to the equal marriage rally and said, “Big rally isn’t it. This sure is living proof the equal marriage campaign is a revival of the queer movement today.” They went quiet. So I distributed them Green Left Weekly I had paid already for the right to do in Melbourne. I distributed 25 copies a week that I paid for out of my own pocket even if that meant sometimes having to go hungry. I told people if they offered to give us money I just said, keep your coins we want change I have already paid for the right for you to receive Green Left weekly from me. 

369.          I only came back for court dates during that period because I risked arrest if I didn’t. I returned to Melbourne and we came back via the NDA abortion rights contingent from Melbourne. I didn’t want to come back and do more court but I was informed that I had to keep going through the court whenever requested to do so until the APVO was annulled.

Dropped charge 3)        The Chippendale Activist Centre

370.          On 7 June 2010 Matthew Payne from Street Level and myself went to all of us comrade’s place of work (Its Socialist Alliance Not Rachel’s Alliance) at 23 Abercrombie St in Chippendale. This alleged breach wasn’t against Rachel it was to fight for full Socialist Alliance equality and CAAH equality for a trial for our people to hear the truth. I received bastardisation acts from Paul and Pip as a result of the AVO existing to feed them “Mérida about me. We couldn’t afford a sheriff to deliver subpoenas, the speech and the petitions for the trial with Greg. Rachel Evans wasn’t there in person at the time. I wasn’t looking for her I was looking for any comrade who would help get the truth to comrades via an appeal so we can all come home. The Event reference number is E43552888. The police charged me because they acted without common sense investigating the matter themselves.

371.          This is what happened. Matthew stated delivery for the Resistance centre. I guess I was delivery. We entered, Paul Benedeck met me for the first time and made a big announcement on the intercom, “Comrades Shelly’s in the building.” Paul Benedeck crash tackled me and wouldn’t let go of my backpack. Matthew kept saying let her go and just hear what she has to say. All we had done was put our life on the line fighting for comrades to know the truth with civil disobedience and direct action. We said we have to deliver these documents. The prejudice that had built up as a result of the false history the AVO was creating was completely intense.

372.          I entered Stop the Intervention Collective (STICS) briefly but then went into Refugee Action Coalition. Paul Initially had a prejudice towards me as a result of the AVO. He initially would tell people I was trouble and had an obsession but then as he got to know me he eventually let me help him distribute Green Left. I got Green Left Weekly every week. I turned up to every rally for all human rights struggles and went to every organising meeting

Section 1.34    Committing Socialist Alliance acts is not a criminal act

373.          The Charge reference number in regard to the alleged breach referred to in paragraph 227 was H41546828. This matter was ultimately heard on 8 December 2010 at the Downing Centre Local Court. It was organised by NSW police and Paul Benedeck and Rachel Evans. We pleaded guilty, it was dismissed with no conviction. I received a 12 month Good Behaviour Bond under Section 10 (1)(B) of the Crimes (Sentencing Procedure) Act 1999.

374.          The costs I paid was $79 Court Costs, $67 to victim’s compensation and $500 for subpoenas due to the place and communication restrictions. I was required to attend by law or face arrest because I’m on Bail conditions that mirror the AVO. 

Section 1.35    Two Psychiatrists and the Supreme Court declare my excellent state of Health who recognised that victims of trauma, torture, physical and sexual violence and from poverty is not a mental illness. We called for victims of trauma, torture, physical, sexual violence and from poverty to be stripped from being defined as a category or symptom of mental illness under the mental health act. We called for no drugs to be prescribed to victims with a history of suicide.

375.          Two Court physicians certified on September 27 that I was, in fact, in perfect health. Yet, in spite of the repeated orders from the Court; requests both from myself and from the majority of our CAAH people, our comrades, and the rest of the 99% of concerned citizens our people since November 2007 we were all denied by the AVPO power and authority over me.The majority of our peoplehave the right to trial their own accused to stand trial before themat any branch meeting, any conference or court whether special or national to hear what the accused has got to say in person in order to determine a solution and any disciplinary action we can all live as well as the accused. Such as political rehabilitation orders instead of personal condemnation orders. A no texting restriction all that should have been implimented for a short period and I more than served that sentence more than was necessary prior to the three convictions and I more than served that sentence after those convictions for a further 14 months. I have had to apologise for being born my whole life. Everyday I apologise for being born through my actions by those who judge me. Everyday I have to explain my actions and justify why I even breathe. You talk about apologies just once I would like to hear a sorry be given to me actively and for leaders with power and authority over me to explain their actions towards myself for not listening before they go making decisions and judgments about my life and others.  Without everyone’s imput into those decisions including the accused and not just leaders or those with power and authority over people. Its okay for Honourable magistrates and police to make decisions about people but if that decision is not what the majority of people want then the majority of people will be unhappy with those decisions. Things change just because Rachel wanted an APVO yesterday doesn’t mean she wants one today. If she saw what she suspected to be my communication irregardless of whether she received it personally or not.  Even if I didn’t personally deliver it myself she was under obligation by the state to report it even if the communication wasn’t violent and was calling for help to fight for equal rights and life to stop the order because the APVO power and authority over me incited violence and prejudice towards myself.  Even it is not directed towards her she is under obligation to report me just as I am under obligation to attend court and report to police for the duration of the APVO whenever required to do so. That is a problem when it involves a shared community, workplace and education facility and there is place and communication restrictions in place. It essentially means she has to run to the police every 5 minutes even if she has no genuine fear. Even if she or myself are not always there in person ourselves to see what happened. Imagine at rallies how much of a public outcry towards the police and Rachel there would have been if she ran to police during a rally that either she or myself had organised because of this APVO. Is it little wonder I wear tape over my mouth to prevent that occurring so that she wouldn’t receive any condemnation for mistakenly misjudging me. There is public outcry going on because of what others have witnessed but I pulled them up because they wanted to lynch Rachel and the police for their actions in not listening to me.  I reminded them to be humane and maintain an amnesty position in the struggle. Lynching leaders and police for a misjudgment of the people is not going to solve the problem. Organising an active political campaign to fight for equal rights for life and being humane in the struggle is what is solving the problem.  

Section 1.36    Other Costs

376.          Other costs I was also detained for three weeks even though two psychiatrists declared my excellent state of health. We lodged appeals. Firstly the MHRT it’s a trial just like the refugee review tribunal. We lost. Then we lodged the next appeal to the Supreme Court and won with no lawyer. I had to be the lawyer. The independent psychiatrists were finally listened to that both the mental health system and the judicial system were putting my life in danger by using Rachel’s power and authority over me as a weapon to justify keeping me drugged and a prisoner and to let me go fight for equal socialist alliance rights and equal CAAH rights for life for an appeal and the truth to be heard by our people as I was never sick, nor a criminal just a person who was misjudged who needed political rehabilitation and not personal condemnation orders with one’s own people. That these independent psychiatrists would have been worried about me if I wasn’t organising continuous protests to repeal the orders to fight for equal Socialist Alliance and CAAH rights for the appeal to be heard. They also said that Rachel Evans and Alex Bainbridge and the police needed to get it into their heads that I am genuine and to stop looking for hidden agendasthat clearly need a closer examination themselves for misjudging me with a bastardisation attitude instead of just letting us go home to our people. The CTO was revoked out of court and Marrickville Community Mental Health apologised for getting it wrong who told me I was a better Doctor than they were at curing patients. It was good to be drug free and free from  the mental Health system staying out of my life and listened to that I’m not nor ever had a mental illness and the trauma and torture was not considered a mental illness. I began to be taken seriously.

377.          The Magistrate recognised the fundamental fact that these are my people I have been fighting for, more than just a political party or a queer collective, but my replacement family. That I have no criminal history prior to the APVO that resulted from clearly being misjudged. The Magistrate went on to say that this is a person who doesn’t belong in the judicial system and is not someone we should be making an example out of due to the amount of trauma and torture she has already received for putting her life on the line to fight for the lives of her people. That after going through the appeals Ms Dahl was left with little choice but to go in there in person because her calls for help to stop the order and for the truth to be heard went ignored.  Ms Dahl is clearly a person that has just want to go home to her people and change the world who shouldn’t be punished.

Section 1.37    The APVO resulted in having to pay for the right to commit Socialist Alliance, to Green Left Weekly, Resistance and CAAH acts.

378.          I went to a film screening for John Pilger.Throughout the course of the struggle it was never my intention to engage in mortal combat. I gave everyone strict instructions to be humane in the struggle that simply because there is a personal condemnation order in place there is no justification in giving personal condemnation in response. I demonstrated it by action.

379.          I went to the Latin American Conference the APVO was used to black entry.

380.          The WikiLeaks campaign inspired me to do this one that comrades and CAAH were dumbfounded when they first saw me do it for the party. I have a history of continued public truth telling through Green Left Weekly prior to the APVO, comrades including Rachel encouraged me to do so. They would help me write the articles. Yet Green Left weekly will continued to be denied from printing a word of this fight for equal Socialist Alliance and CAAH rights because Rachel is the contact person now for Green Left Weekly submissions because public truth telling is considered a criminal act these days.This was at a time where media censorship on public truth tellers was occurring by the US governments for exposing their crimes against humanity. While the US government treated Assange and Bradley Manning as a criminal for reporting the truth to the people, Julian Assange and Bradley Manning was considered a hero by the people. Both Assange, Manning and myself all had something in common in that our public truth telling was being silenced and we were being treated as though we are illegal citizens.

381.          The action that I did to this day that comrades and CAAH people were dumbfounded by I exposed the gag order with tape over my mouth. It linked in well with every rally and every human struggle by the silence everyday people feel in unjust decisions being made about our lives and not being listened to, to stop it. I ended up using cloth because I was going through too much tape and it was better for the environment. It was widely supported as an important part of the campaign. All sorts of methods were used to try and encourage me to not wear it because there were some comrade and CAAH leaders who were uncomfortable seeing me with a gag over my mouth I simply said until that order is gone at every rally and every situation where there was a possibility of recieving any hint of Rachel’s AVPO power and authority over me I wear a gag over my mouth. Organising meetings were the only place I didn’t wear the gag over my mouth, but wear it around my neck just in case. Even Emilia Lawonski wore tape over her mouth in support of the campaign.

382.          We went to the John Pilger Film Screening but the APVO block entry but Paul let me fight for the right to help distribute Green Left Weekly. On the stalls at the Wiki Leaks rally I asked Paul why I have to fight so hard for Green Left. He told me I just do.

383.          As a result of the APVO I had to pay for the right to commit Socialist Alliance, CAAH, Resistance and Green Left Weekly Acts. I received bastardisation acts as a result of the APVO. Through continued insistence on committing Socialist Alliance acts with comrades and community action against homophobia acts with our queers. Comrades eventually got it through Green Left Weekly that I’m having to pay for the right to commit Socialist Alliance acts and CAAH acts as a result of Rachel’s APVO power and authority over me. Fred Frentes, Paul benedek, Duncan and Aaron Roden, Ben Peterson, Rupen Savolon, Luke Weyland, Red haired Stewart, Sue Bolton even though they didn’t understand exactly what the politics of the campaign was about became completely supportive of the campaign for equal Socialist Alliance and CAAH rights and helped me demonstrate I’m having to pay for the right as a result of the APVO but through civil means was better than condemnation means.

Section 1.38    The Blue Mountains

384.          On 18 July 2010 IOccupied the Blue Mountains where the people did have great empathy that was 12 months ahead of central’s time. I got to talk politics with comrades, the right to Green Left Weekly and didn’t have to fight to get in as a result of the AVO. It was politics in the pub and the organisers had to tell John Toggs to settle down who couldn’t control himself cause he didn’t like what the ALP candidate was saying.

385.          On 25 July 2010 which was established in law that I went to the Blue Mountains Socialist Alliance film screening on the Northern Territory Intervention but was not criminally charged for it. I was invited by Maureen Grant and due to the restrictions had no way of knowing Rachel had the same idea as myself to be there. I carry leaflets and petitions and political material around about the History will absolve us campaign to distribute to anyone, like I do for any campaign. I wasn’t happy with the political material I had created for the campaign because I like comrades checking my work before I distribute it, but due to the APVO I risked arrest for even asking. I went to the mountains cause that’s what Castro did when this happened to him. Rachel couldn’t hide her laconic attitude and disgust about having APVO power and authority over me. Rachel, Viv everyone else was allowed the right to speakbut as a result of the APVO I had to fight for the right to speak.  As a result of the will of the majority of people the right to rebel to unite with the majority won. They helped fight for my right to Socialist Alliance to equally participate and speak. It was incredibly inspiring. The people said keep my hand up and to keep standing up for our rights soon literally the whole room of about 40 – 60 people literally chanted to Viv to drop the AVO, give us an equal fair go for the equal right to speak for the rights of aboriginals.Viv and Rachel backed down because they knew they were going against the will majority in carrying out Rachel’s APVO power and authority over me. Comrades from the door entry distributing Green Left just grinned and gave us the thumbs up.Rather than condemning the actions of the leaders as I had been condemned I spoke of the continued need to Alliance for a united mass campaign to end the Northern Territory intervention and asked questions and everyone applauded and cheered because it was a victory to finally be listened to. Exposing the gag order with tape over my mouth had worked in waking up mass consciousness to call it amnesty. Just like the email I had sent in response to Greg’s prejudicial email. So I gave Maureen a copy of the first version of this testimony with petitions calling for the appeal to be heard for amnesty to annul it and asked her to give it to the leaders.

386.          I went back to the city with hope in my heart. It was the truth that a horrible and inhumane misjudgement of me had been made and that unlike other accused persons I hadn’t been condemning I had been fighting for equal Socialist Alliance and CAAH rights and for our people to know the truth to win those legal rights.

Section 1.39    Refugee Action Coalition

In refugee action coalition Paul Benedeck since seeing us work together in organising has radically changed his position. He realises that a misjudgement has occurred and that what he was told about me wasn’t true. That his belief was only developed as a result of the APVO. In fact what comrades and CAAH people do to show their support for this campaign that I organised to fight for them in response is every email they send they put the words (disarmed) to let everyone that know I don’t have to worry that their not going to give us the APVO using Rachel Evans power and authority over me and give us a go. The APVO is a weapon and in a leaders hand if not used appropriately it can cause harm to another person. I don’t have time nor do I agree with using weapons to cause harm. I can’t even pick up a raiser blade to shave my own arm pits that’s how much weapons scare me. Five years ago I used to cut myself whenever I received an act of blame or took an overdose to escape violence and prejudice being done to myself. Today I can’t do that. I can’t even take headache tablets if I am in pain. I take vitamins. I had a lump in my cheek about two month ago that was in a lot of pain and wouldn’t stop growing. The doctor spent four hours trying to convince me that I’m not going to die if I take those pills for a short period to make it better because its for a physical problem and won’t cause harm to my brain, heart or nervous system or organs. It was only after I saw the forensic evidence from the tests that I took the pills and the lump went away. I haven’t had to take the pills since.  

Occupy the Courts 13                      Cross claim appeal refused

389.          On 28 July 2010 at Parramatta District Court my application for leave to appeal for the cross claim from 22 March 2010 in the District Court was refused to be heardand was dismissed by Honourable Judge Sides.I wasn’t permitted to submit written evidence and none of us were permitted to verbally give evidence. I had thought an Honourable Judge with experience in determining cases involving the civil liberties and human rights of political activists and revolutionaries from our people to stop state orders abusing power and authority over people for exercising their democratic right to unite with the majority in organised political human rights campaigning would see common sense. Yet he was more interested in protecting an order which uses a leaders power and authority over a person to torture them for fighting for equal protection of human rights and civil liberties in committing Socialist Alliance and CAAH acts to unite with the majority to fight for life as an important part of the revolutionary struggle. Maybe if he had just listened to the case instead of blaming me for doing something through the only means I was permitted to annul the APVO which put human life at risk from the very violence and prejudice I received that these orders are supposed to stop everyday it has existed he would have realised there has been no justice in it. 

Section 1.40    NYA 2010

390.          During NYA Rachel would deliberately march in front of me so I would try and always head straight to the front. I kept tape on my mouth and that’s when Rachel made a number of attempts to test us to try and get us to speak, she would make all sorts accusations demanding confession, or ask us if I had a death wish or would ask us if I wanted the police always demanding a confession. That combined with detainment and continuous acts of bastardisation and hate as a result of the APVO being used to demand a confession after three years of constantly receiving it on a daily basis from a few leaders resulted in the first lot of text messages. 

(Texting conviction) 1                        

391.          Between 26 July 2010 and 23 August 2010 numerous texts were sent to everyone about the organised History Will absolve us campaign for equal CAAH and Socialist Alliance rights and calling for help to fight for life for the truth to be heard, for the solution to the warnings be listened to were sent out on mass. 59 text messages which equates to about two text messages a day were sent out to everyone by everyone about the politics of theHistory will absolve us campaign. These were only of having Rachel’s APVO power and authority over me being used to demand a confession for three years. They were a communication act and not a violence act towards others to call for help to stop violence, bastardisation, homosexual assault, redbaiting, prejudicial acts, detainment and torture that was happening to me as a result of the APVO power and authority over me as a result of being misjudged as a result of detainment and gag orders and not being listened to in the first place. Rachel used her APVO power and authority over me to block my every means of communication with comrades and CAAH since November 2007 and not just with the students at UWS since May 2007 or from speaking out for the people at rallies and then herself since November 2007. Yahoogroups, google groups, Facebook, groups, in person communication that put my life in danger to prevent the truth from being heard.

392.          It’s all well and good to protect one person’s human rights but it should not be at the expense of punishing another to death for calling for political and organisational help to fight for life from the majority of people you trust. I wouldn’t have had to text for help if I had just been listened to in the first place instead of being misjudged without a civil trial that resulted in my life being put in constant danger. I defended her politics, I defended her organising, I defended her human solidarity, but I do not defend her or any leader having APVO power and authority over anyone which attempts to destroy and shut down anyone, not just myself in uniting with the majority in committing Socialist Alliance and CAAH acts in the fight for human life as an important part of the revolutionary struggle for calling for help in that task based on a misjudgement as a result of the denial of a civil trial and hearing of the appeal on the matter.

393.          It is standard practice political and revolutionary practice in emergency situations to send out SOS calls for help to fight for life. I was detained at the time and didn’t have that phone on me at the time. Given Ms Evans AVPO power and authority over me had been used to block all communication means in order to get the truth to our people such as yahoo groups, Facebook, twitter and that she had told comrades and CAAH people to delete our voice with a bastardisation comment. In all of these text messages Rachel Evans name was not mentioned

Section 1.41    Texting Conviction One

394.          On the 5 September 2010 Rachel Evans reported these contacts to police.Event Reference number E41156709. The Honourable Prosecutor will argue I got some sort of satisfaction out of going to court when throughout the course of the struggle from day one I have said repeatedly I hate court because there is no justice in this system, just personal condemnation and no rehabilitation. I wouldn’t have had to text if Rachel had not gagged and detained me in response to the actions of the student union leaders instead of addressing the real issue that goes back to when I was six weeks old that I have never been given a chance to defeat for life. Just keep our mouth shut, stop crying, don’t do anything about it, tolerate it and clean up the mess while they never deliver on their promises of Oranges and sunshine is leaders with power and authority over us children attitude.We’re all adults now and yet the judicial system is still making us pay the price for doing what this system failed to do. The police will just keep pursuing it after all they’ve been using leaders power and authority over children to take them whether gay straight black who are born from adultery in poverty from their mum’s, brothers, sisters since the first refugees arrived from England still to this day based on a lie without question. I’m not the one who organised it being taken to court in the first place. I wanted a conference or a branch meeting and civil trial instead of criminal trial to take place in order to call it amnesty. The majority of the incidents I didn’t even know had happened due to the place and communication restrictions until I either subpoenaed records or was arrested or contacted by police about it. The NSW police were the ones who insisted court was the only option to sort out an internal matter and where a hearing of an appeal to resolve the matter would occur back in September 2008.  Comrades and CAAH people even referred the matter back to court because I am under obligation as an accused person to attend court as per the Bail Act of 2007 or face arrest until this APVO is annulled and triple zero stops being called on me as a result of Rachel’s APVO power and authority over me. I can’t ask Rachel to revoke the AVO for my freedom I have to fight for it by fighting for equal Socialist Alliance and CAAH rights for life that I have continued to do. Yet you are all so busy finger pointing to misjudge me to just stop and listen to just let our people give us a go that will overwhelmingly prove through a civil trial and not a criminal trial that there was no justification if the ever was for both the original AVO or this extension by the NSW police in the first place since 2008.

Section 1.42    Texting Conviction One

395.          On 13 September 2010, Police charged me with breaching the APVO. All text messages between 26 July and 23 August were encompassed into a single charge. The charge reference number is H41685744. The Honourable Magistrate ruled it was at the lowest end of the scale.

396.          On 25 March 2011, I pleaded guilty communicating and not guilty to any breach of the act in the Newtown Local Court in relation to this matter.

397.          A breach of a communication restriction is not necessarily a breach of the act. Whether a breach of the act has occurred has not yet been proven. A belief, maybe, might, think feel, probably is not a fact. Someone continuing to go to work to fight for their job, to unite with the majority for equal rights for the workers even though the boss don’t want them because of their misjudgement or ignorance or prejudice of the worker while the majority of the workers do want them is not a stalking act that is a revolutionary protesting act. To examine whether the texting conviction were a breach of Section 13 of the Crimes (Personal and Domestic) Act 2007 to determine whether an order should extended or not we must look at the content as to whether a rational and reasonable recipients human rights would be violated in receiving these messages as per all the sections. Bearing in mind that Rachel Evans holds a leadership position of power and authority over me in our political groups.

398.       The price paid

399.          The costs I paid for fighting for the truth to be heard was $200 fine, $79 court Costs, $67 victims compensation, due to the place and communication restrictions $500 for a sheriff to deliver 8 subpoenas plus $120 interest to Cash stop for the loan to pay for this. Other Costs include two weeks inside detainment where the NSW police took me upon arrest plus another 3 months outside detainment. This is what continued to happen as a result of detainment since September 2007 I was physically, sexually, verbally assaulted and tortured for a confession, to either accept Rachel’s AVO or continue to receive a chemical lobotomy of 100-600ml zupenthixol injection and killed by the mental health system. If it hadn’t been for memories of comrades and CAAH people as well as Street Level, Dr Heint and Dr Lee Chin I called in secret I wouldn’t have won freedom or come out alive who help pulled me out of the mental health system via the supreme court because I never had a mental illness. The Mental Health System did it because they wanted comrades and CAAH to think I was nuts so then they could kill me and make it look like a suicide because of what I know could help comrades and CAAH help the people stop the deaths of unlawful detainment and drug experimentation of victims of domestic violence, rape, trauma, torture, homosexual assault from poverty, who are refugees, lgbti or political activists or revolutionaries who never had a mental illness until they were fed these drugs.  The victims of the above violent acts don’t have mental illnesses when not on the drugs.  The mental health system put healthy normal rational people from poverty who experience an injustice on these drugs and if they don’t take it as a pill they inject them with an overdose so that when they are put before the mental health review tribunal the patient is all drugged up, the doctor gives a false report and unless it goes to the supreme court the mental health system wins legal control of individuals from poverty they make money off. They break adult human beings nervous system down to the level of infants who wind up dead only the strongest can survive it fighting for years to break free. That’s why those text messages got sent to any comrade for help between July 2010 to August 2010.

400.       Changed my phone number

401.          I then also changed my phone number. This was the third time I had changed my telephone number since I met Rachel Evans in 2006. This was the seventh time I had been arrested for fighting for Equal Socialist Alliance and CAAH rights seeking asylum with my replacement family Socialist Alliance and CAAH to help change the world under Rachel Evans abuse of power and authority over me by APVO.

402.       Double Standard Rachel was never charged for sending political communication via email

403.          Throughout the APVO I continued to receive email political communication from Rachel Evans, comrades and other CAAH people wanting me to continue to come to work to help organise, attend events etc. Since November 2007 I continued to receive life threatening, torturous and prejudicial text messages, emails and verbal communication incited by Rachel’s, Alex’s, and the NSW police APVO as a result of their misjudgement of me.  I do not know how Rachel knew I was in Melbourne or many of the groups I go to with comrades and queers to help organise political campaigns and she uses her APVO power and authority over me to try to shut it down when I have not spoken with her. I do not know how she got my number.

Dropped charge 4)        Anonymous banner

404.          On 11 September 2010 according to subpoenaed records from police a political amnesty banner was hung by anonymous persons from Rachel’s front fence in Newtown. An apocryphal male flatmate witness of Rachel’s who told the police he had never met me while walking up Rawson St, Newtown at 5:30pm noticed a woman on the corner 2-3 metres from Rachel’s house. At 6:15pm an apocryphal female flatmate of Rachel’s named “Caroline Turnout” who I have never met found a banner and contacted Rachel who then came home. There was a socialist event on in Marrickville at the time. The witness couldn’t identify me and they couldn’t proceed with their case. Rachel under obligation by the court who is an experienced organiser who knows from history many people put up posters/banners to promote organised campaigns to stop injustice who are not necessarily the authors of the work based on a “belief” then contacted police who came at 11:30pm.   On Thursday 15 September 2010 Police contacted me to participate in an ID parade of which I declined because the Police already have photos of me. Event number E41797152.While true our banners usually have the web address of the name of who we are and what we have organised a campaign to fight for. Our banners usually have one slogan on it and we don’t put phone numbers on them. We also don’t usually list more than one slogan unless it’s like this big banner us queer comrades, CAAH people and queers dropped together at G20 in 2006. Was the banner like this one? If not then it’s not ours.

Dropped charge 5)        Abuse of APVO power and authority over me

405.        On6 December 2006 at the Downing Centre Local Court I was found not guilty for the posters from anonymous concerned citizens exposing the frame up on the 14 September 2010. Event number E42160104. Charge number H41724937. Pictured here is the official posters of the campaign not the ones I was shown. It was proven it was an illegal arrest, an illegal detainment, an illegal interview, about the wrong day with a made up alibi named, “Stephen”I’m yet to meet to obtain a confession in order to attempt to gain a conviction using Rachel Evans APVO power and authority over me to pursue the extension based on a belief since November 2007 without civil trial or a criminal trial first. Neither the police nor Rachel Evans used any common sense in investigating the matter with no place or communication restrictions to allow civil trial proceeding to take place in order to assist Honourable Judges and Magistrate before proceeding with a criminal trial. How was in police custody on the 13 of September 2010 how could I be in Parramatta at the time of the alleged incident?

Section 1.43    The APVO contradicts the Commonwealth Torture and death abolition act 2010

406.          I am the victim in this case and not a perpetrator who did something good about it for my people even though I was scared. I told police I didn’t want to talk to them because don’t listen and they haven’t listened since 2008 that this AVO is false and inhumane while denying my people the right to civil trial me instead of criminally trailing me for doing what any rational human being would do for their people based on a belief and a misjudgement of me without civil trial in this case. This charge only further demonstrates for four years for calling for help to fight for life persons with power and authority over me in their official capacity implemented an APVO including the extension to torture and punish me the purpose of punishing me for acts which they alleged I committed or is suspected of having committed for the purpose of obtaining confessions for convictions instead of rehabilitation or to attempt to coerce me to accept what is not true about me to gain convictions to pursue the extension to continue to criminalise committing Socialist Alliance and CAAH acts. It did inflict severe physical and mental suffering on me that my psychiatrist is still baffled in how I have managed to stay alive through it and still be in good mental health. This charge demonstrated that this APVO in this case contradicts Section 274 of the Commonwealth (Torture and Death) Abolition Act of 2010 of using a leaders position of power and authority over a victim to torture them by:

-          (a) engages in conduct that inflicts severe physical or mental pain or suffering on a person (the victim); and

-          (b) the conduct is engaged in:

-          (I) for the purpose of obtaining from the victim or from a third person information or a confession; or

-          (ii) for the purpose of punishing the victim for an act which the victim or a third person has committed or is suspected of having committed; or

-          (iii) for the purpose of intimidating or coercing the victim or a third person; or

-          (iv) for a purpose related to a purpose mentioned in subparagraph (I), (ii) or (iii); and

-          (c) the perpetrator engages in the conduct:

-          (I) in the capacity of a public official; or

-          (ii) acting in an official capacity; or

-          (iii) Acting at the instigation, or with the consent or acquiescence, of a public official or other person acting in an official capacity.

Section 1.44    Rachel communicated almost 600 emails to me throughout the course of the struggle.

407.          Rachel throughout the course of the struggle her emails continued to arrive in my inbox right up until about July 2011. Dare I reply with the exact same equal political communication with the people as hers and that is treated as a criminal act. The APVO essentially resulted in us both having tape over our mouths.

Section 1.45    Texting Conviction Political communication conviction

408.          On 16 September 2010 everyone received seven text messages spoken by me but written and sent by someone else after I lost my phone. They were breach of communication restrictions not violence being done from myself towards others but to stop violence and prejudice being done by others towards myself incited by Rachel’s AVO power and authority over me and call it amnesty for life as an important part of the revolutionary struggle including the organised campaign for equal marriage since November 2007. They were a call for help to stop severe mental harm being done to myself from the actions of others incited by Rachel’s AVPO power and authority over me towards fighting for equal socialist alliance and CAAH rights for life.  They are attached on the next page.

Section 1.46    Reporting of the charges

409.          On 17 September 2010 Rachel Evans reported these alleged breaches of the APVO to Newtown Police referred to in Police Event number E43075516. In her affidavit it’s not uncommon for revolutionaries to be misquoted by those who don’t listen to us to begin with, but yet you don’t expect your own comrades to misquote you or use it to personally condemn or incriminate yourself no matter who sends the message. It talked about having to fight for freedom for myself for the right to go and help organise campaigns to fight for the freedom of others such as queer refugees like Leila Krushna. It talked about how the AVO put my life at risk and that the AVO is like Villawood detention in the sense your legally recognised but yet has to keep waiting on a security clearance never knowing when your release date is going to be. Your given a date but that release date never comes because I refuse to stop fighting for my party and CAAH for life they will just keep extending it and Rachel will just keep punishing me to death for the rest of my life instead of just calling it amnesty and let us come home to our people. She will most likely never submit this to the party. I know she wants to silence me because she’s scared of comrades and the judicial system knowing the truth that she told bullshit about me because they wouldn’t listen to the truth because she thought that condemning me was the best way to get us to fight for life. Yet the harm done outweighed any mutual benefits such a method created. As a new person I had already been misjudged by ignorant leaders in the SRC who wanted to lobby instead of organising campaigns it didn’t help having other leaders do that too within our own people. Someone else did use my phone to send those messages because they thought it was important for comrades and CAAH people to know.    

410.          She was visibly upset because her power and authority over a person by APVO is mistakenly inciting prejudice and hate causing severe mental harm towards another person’s human life. She had the same reaction when she visited me in RPA at the thought of losing her comrade in September 2007 when I was receiving the same bastardisation and torture acts as a result of Luke Stalin Fomiati’s actions from the SRC for fighting for organised campaigning to fight for life as an important part of the revolutionary struggle. (In the words of Che: I’m still alive mum like they never wanted me to be you stupid fool for misjudging me who needs to swallow her Pride, bitterness and stop scaring me to death, call it amnesty for life with a political rehabilitation order instead of a personal condemnation order and pull her comrade out of this pile of shit you put me in as a result of not listening and bring us home to keep your promise of oranges and sunshine before our common enemy captures and kills me like they did to che)

411.          The Honourable magistrate Keller 6 December 2010 highlighted it doesn’t matter who wrote a message which are political in nature unless you have photographs, CCT footage or a witness who saw that person your accusingin person commit the act you want to convict them on the evidence is circumstantial, belief and speculation and not necessarily a fact. I had my psychiatrist and members of the community as well as various lawyers examine the contents of these messages. They all agree that these messages are from a victim being inhumanely tortured prejudicially by APVO based on a misjudgement of them using a leaders power and authority over them with who is calling for help from their people in fighting for equal socialist alliance and CAAH rights to stop the AVO which is causing it. I don’t have a death wish, I never have, yet it seems as though others do of me.  I am not the enemy. I am a comrade of my people including Rachel whose power and authority over me is being used by the state to treat me as the enemy and an illegal citizen for seeking asylum with my replacement political family which includes CAAH that I risk being criminally charged for organising the equal marriage campaign. I commit Socialist Alliance and CAAH acts and would continue to fight for the right to continue to commit these acts with our people even if I had never met Rachel as I did when she wasn’t in the country during the stay period. It was Green Left Weekly whose joined to my hip who convinced me eight months before I even knew of the existence of a Rachel Evans my replacement mother. The bastardisation actions of leaders towards me incited by Rachel’s APVO power and authority over me based on Alex Bainbridge’s and Rachel’s misjudgement of me without civil trial shows me Rachel unintentionally and the NSW police intentionally just want to punish me to death with a personal condemnation order instead of a political rehabilitation order. Instead of letting our people hear this appeal for a civil trial and the truth which would annul it to just call it amnesty and we start again for fighting for equal Socialist Alliance and CAAH rights since November 2007 after I came out of the closet about being stolen for being born from adultery.

Section 1.47     

412.          On 18 September 2010 I was arrested and charged in relation to the alleged breach referred to in Section 9.43 and 9.44. The Charge reference number relating to this event is H42095559. This matter was ultimately listed for hearing before the Newtown Local Court 22 July 2011. The Honourable Magistrate Quinn acknowledged this was a communication breach and that there is no history of the mandatory orders being breached. She acknowledged it was at the lowest end of the scale. That it was not an act of violence towards others but a call for help to stop an APVO using Rachel’s power and authority over me which has been inciting prejudice while making one an illegal human causing severe harm to myself from day one. The Honourable Magistrate asked me what my sentence should be, I suggested to call it amnesty with political rehabilitation with my people instead of personal condemnation orders to stop making one an illegal human for seeking asylum with their replacement family but she told to recommend that when the APVO extension gets heard. She imposed convicted and placed on a four month Good Behaviour Bond with $279 fine, $79 court costs, $67 victims compensation, $500 for the subpoenas of witnesses who were denied by the Honourable Prosecutor from giving evidence. The whole case was then redirected to the Downing Centre Local Court on the grounds the APVO had created prejudice and bias in the first place towards me as a result of only having one Honourable Magistrate residing over the matter in the first place and not permitting all evidence to be heard. 

Section 1.48    Texting Conviction Three

413.          On 7-9 October 2010 two texts were sent to everyone by Craig Redroff who both Paul Benedeck, Briana Pike had met after the victory we had had in the Ryde Local Court 7 October 2010 in which I was found not guilty of the charge from Gregory Rowell. It was proven the charge resulted from Rachel’s APVO power and authority over me. It was proven because all my means of communication was gagged I was being misjudged since November 2007 and that I wouldn’t have had to text if equal Socialist Alliance and CAAH rights had been respected if Greg, Rachel, Alex or the police had just used their common sense to stop gagging every means of communication with our people to let them hear the truth and listened instead of finger pointing to misjudge me and had just been permitted to come to work in the first place. To continue to fight for life and that a civil trial and hearing needs to occur to call it amnesty.

414.          The second message was that despite that fact my witnesses had come to give evidence my lawyer didn’t listen to me to let the people speak.

Section 1.49     

415.          On 11 October 2010 Rachel Evans reported these texts to the police as an alleged breach of the APVO. The Event Reference number relating to this alleged breach of APVO is E42425204.

416.          On 12 October 2010 I was arrested and charged with the matters in Sections 9.46 and 9.46. In custody the police told me they were pursing an extension because I refused to give up fighting for equal Socialist Alliance and CAAH rights for our people and for refusing to stop committing Socialist Alliance and CAAH acts. It was very clear in my mind from day one they were using Rachel’s power and authority over me to make it a crime to unite with the majority to commit Socialist Alliance and CAAH acts   The Charge reference number for this event is H81784301.On 25 May 2011 at the Downing Centre Local Court, a plea of not guilty was entered. This matter was for hearing on 5 December 2011 at the Downing Centre but again not all the evidence or witnesses were permitted to be heard. Craig Redroff would have liked to have defended us as to why he used my phone to send those messages. Yet unfortunately sometime between 25 July 2011 and 16 August 2011 the APVO killed him while I was detained for three weeks and Resistance Books was denied from entering the trial for telling the truth in court that Paul does want me as we work together in RAC and wouldn’t have called the police if there had been no APVO. I came home after being tortured for a confession, physically and sexually assaulted, drugged and gagged for three weeks after they realised Magistrate O’Shane had made a grave error. I found Craig who had been dead for three weeks in my flat who was as black as an aboriginal. He left a book called Australia’s greatest Crimes. The Rookie cop threw up it’s the only time I’ve seen the police act humane.  Craig Redroff my flatmate was just a concerned citizen from poverty who had never been given a chance in life who was loved by the Street Level Community who bravely fought for amnesty to be declared via a civil trial such as a special conference to annul the unjust APVO power and authority over me just like Colin Campbell did. He told me I had given him a purpose in life. The police didn’t even investigate the matter thoroughly. I did. I was left to clean up the mess. I called for a Coroners inquiry but the police wouldn’t do it for his real family at Street Level who were denied from paying their respects to Craig because his biological family wouldn’t give their consent who cared more about money who didn’t care about him when he was alive because he lived in poverty who told me Craig was just an embarrassment to his family they just wanted to bury.  Had Craig’s testimony of what he had witnessed the AVO cause been heard the proposed APVO extension based on this charge including the original would have been annulled and I would have been found not guilty.

Dropped charge 6)        Rachel never had a genuine fear of violence from me.

On 12 October 2010 the APVO power and authority over me was abused again. According to event number E42518626 someone sent a text message from a pay phone. I was in police custody at the time only concerned citizens could have sent that message from a payphone. Police came and visited me at my house asking me if I knew anything about it. I told them that was the first I had heard of it. They didn’t proceed any further. Maybe because Police finally told the truth in this event number that Rachel “doesn’t seem to have any real sense of fear in terms of violence between the two with no incidents of violence over the last two years.” Who is a afraid of the truth and who is not that this AVO extension using Rachel’s power and authority over me including the police extension from day one has been a frame up? Rachel is only carrying out the APVO because she is under obligation by the state to do so because I dare say the police never advised her she could annul or revoke it at any time
