This is not complete. Though belatedly due to place and communication restrictions, I am completing these notes as promised under incredibly difficult and inhuman conditions in response to an Affidavit that have been fighting to do since November 2007 that would help the courts, the party and CAAH to resolve this situation that developed between Rachel Evans and myself. I have been occupying since November 2007 for full equal Socialist Alliance, Resistance, Resistance Books, Green Left Weekly and Community Action against Homophobia rights, hoping in this way leaders power and authority over me will stop being used to personally condemn me but politically rehabilitate us so that Rachel can keep her promise of return from leave of absence without punishment. I would like to do so by dealing with the theme set forth in the title above. It may be of interest to comrade and CAAH readers as Che Guevara thought it was when he wrote about Socialism and Man in Cuba to the Uruguayan readers 47 years ago 12 March 1965.

While true Che’s speech needs to be updated to Socialism and Human in Australia this struggle this testimony doesn’t quite fit completely into Castro’s speech History Will Absolve me and it doesn’t completely quite fit completely under Socialism and human as it needed to combine all the words of all the revolutionaries that have ever existed in order to explain why Annulling the APVO power and authority over me has been so important because when it comes to life winning equality it wants as the very reason why CAAH exists.  When it comes to life winning a revolution it wants as the very reason why Socialist Alliance exists as Farida Iqbal once told me one does anything to fight for it. 

An important thing to note is from a very early age I have always had to fight to be given an equal go in life because of the misconception and ignorance by those with power and authority that people from poverty are stupid. Marion had to fight for us to just be given an equal go in a public school because of the misconception children born from adultery are born stupid and that I wouldn’t accept that my birth mother didn’t want us because my birth mother came and visited me despite being told not to by DOCS and Lester. When I started asking questions at two years old about the woman in the Doctors surgery who wanted me when Marion took me for a vaccination, Lester used the state to get rid of Marion as well as myself by the time I was eight and had Susan my birth mother put in a psychiatric facility. The underfunded public education system even though I was doing high school work in year one and the teachers had recommended I be put in high school, the principle’s refused because of the misconception that people from poverty are stupid.

People have a right to know the truth that not every APVO is genuine. If a leader of a workplace organisation applies for an APVO on another person from the same organisation then it has got to be questioned especially in cases where the accused person is a new person. Especially in cases where past suicide and self-harm and calls for help to fight for life are reported in the applicant’s application. A person calls for help because they are experiencing violence and prejudice as a result of those with power and authority over them misjudging them. So if a person is using too much of one form of communication to call for help such as texting does that mean using the leaders power and authority over that person who texted too much in the past to put total communication and place restrictions on their entire human existence to personally condemn them to death? No! That means opening up other means of communication to find out what the issue is and coming up with a mutually agreed solution between the accused and the victim in order to resolve it to politically rehabilitate them for life.   

What scares me the most is how a leader for four years since November 2007 was able to convince others with power and authority to use her power and authority over me to personally condemn a victim for calling for help to fight for life, to finger point instead of listening that political rehabilitation and not personal condemnation was the answer. I understand she told bullshit because they didn’t want to listen to the truth about me.

The one thing I give Rachel credit for throughout the course of the struggle is that in her own brief of evidence when she organised the court case back in 2008 is that in writing she never signed anything that denied who I am. She in fact provided proof that I am a Socialist Alliance and CAAH activist with a CAAH work reference in her own brief of evidence.  That was when I knew it wasn’t genuine APVO.  I most likely would have died 5 December 2008 when that APVO using her power and authority over me was legalised because the truth was denied from being heard if she hadn’t put that evidence in her brief.

In the 70s lgbti people were criminally charged for committing mutually consented sexual acts. I find it ironic in the 21^st century it is found hard to accept lgbti people work together the same as our heterosexual counterparts who don’t have a human need or desire for sex with each other.

The only reason I went to Rachel’s house in the past is because she insisted on storing my property at her house when I was homeless. When she came back from Bolivia in February 2008 I had my own house and organised for the removal of my property. I left my phone at her house if she considered it such a problem to get rid of the phone and open up other means of communication to resolve this. I did that because I kept being told to wait for Rachel before proceeding with any trial of myself by others.

A common argument from the mouths of capitalist spokespeople, in the ideological struggle against socialism, campaigning and the fight for equality involving the replacement of the family, is that socialism, or the period of building socialism into which we have entered, is characterized by the abolition of the individual for the sake of the state, for the sake of the maintaining leaders status quo when a misjudgement of a new person occurs. I will not try to refute this argument solely on legal or theoretical grounds but on all grounds both politically and humanly to establish the facts as they have occurred in Australia. I will do this by sketching the true history of our revolutionary struggle before November 2007 and after November 2007 when the APVO took power using Rachel Evans power and authority over me.

Che said when this happened to Castro, “The exact date of the beginning of the revolutionary struggle — which would culminate in January 1959 — was July 26, 1953. A group led by Fidel Castro attacked the Moncada barracks in Oriente Province on the morning of that day. The attack was a failure; the failure became a disaster; and the survivors ended up in prison, beginning the revolutionary struggle again after they were freed by an amnesty. In this process, in which there was only the germ of socialism, the individual was a fundamental factor. We put our trust in him — individual, specific, with a first and last name — and the triumph or failure of the mission entrusted to him depended on that individual's capacity for action. Then came the stage of guerrilla struggle. It developed in two distinct environments: the people, the still sleeping mass that had to be mobilized; and its vanguard, the guerrillas, the motor force of the mobilization, the generator of revolutionary consciousness and militant enthusiasm. This vanguard was the catalyzing agent that created the subjective conditions necessary for victory.

My strategy was not to condemn simply because we were being condemned but to simply to call on all of us to clean up the mess together with a solution we can all live with rather than putting all the burden on a few to clean up the mess before it’s too late. We tried on a number of occasions to see Rachel’s lawyer but was always palmed off to another law firm and Ms Main I understand she’s got a job to do but she doesn’t listen

In our struggle as is well known began July 2006 where there was indeed a good comrade relationship that was put to the test from November 2007 that resulted in two comrades becoming scared of each other with an order in place that was like a three legged race with both running in opposite directions and not getting anywhere. The exact date which would culminate the fear of each other as a result of the order November 2007-February 2008 –was 29 August 2008. A couple of leaders Alex Bainbridge and Rachel Evans from the dream team used the guilt fix method combined with place and communication restrictions without trial on an sos call for help to fight for life that resulted in a misjudgement of one of their newest comrade, myself. Instead of political rehabilitation order a personal condemnation order resulted from the misjudgement of their comrade. The misjudgement resulted in the order, the order resulted in a failure, the failure became a disaster, the disaster became a nightmare and the survivors hoped that once the truth was heard by our people the solution of amnesty to all the warnings would finally be listened to would free them from the prison to continue on the revolutionary struggle.

In this process, in which there was only the germ of Socialist Alliance and CAAH, two individuals realisation that each other’s humanity is not the enemy became the fundamental factor in relation to the uniting question whether we like it or not. New cadre’s put their trust in leaders to show them the way, leaders put their time and energy into training their new cadre – both individual, specific with first and last names – and the triumph or failure of the training mission entrusted on the new cadre depends on the leader’s faith, guidance and allowance of  the new cadre’s developmental capacity into action. Then came the stage of Guerrilla struggle in defeating the “Mérida” and the injustice that the order created that created a false history. It developed in three distinct environments: Those who refused to allow the APVO make them go to sleep and those that the AVPO order caused to go to sleep since the day a few leaders created the APVO we live under; the people, the mass that had to be mobilised; and Socialist Alliance, CAAH, the organisers, the motor force of the mobilisation, the generator of the revolutionary consciousness and militant enthusiasm. This vanguard and CAAH was the catalysing agent which created the subjective conditions necessary for victory in the History Will Absolve Us campaign.

Here again, in the framework of the proletarianization of our thinking, of this situation that took place in our habits, our minds and hearts, the individuals was the basic factor. Every one of the combatants of the Socialist Alliance who reached an upper rank in the revolutionary forces has a record of outstanding deeds to their credit. They attained their rank on this basis without it being at the expense of other cadre’s human life just to maintain their status quo. I hope this not quite perfect or complete inarticulate letter will be finally listened to.
